EXItIBIT B <br /> <br /> CONDITIONS AND RESERVATIONS TO GRANT OF EASEMENT <br /> <br /> (TEMPORARY CONSTRUCTION EASEMENTS: <br /> SEAPORT BOULEVARD CONSTRUCTION) <br /> <br /> The foregoing Grant of Easement is made subject to the following conditions and <br />reservations by Grantor, and acceptance of the Grant of Easement by Grantee shall constitute <br />Grantee's acceptance thereof: <br /> <br /> 1. Grantor reserves the right to use the lands described in Exhibit A in any manner <br />not inconsistent with the easement granted to Grantee herein. <br /> <br /> 2. Once construction of the road for which the temporary construction easement is <br />granted has been completed, or within six months of the first use of the road, whichever is <br />earlier, this easement shall terminate and grantee agrees to record a reconveyance evidencing the <br />termination of this easement, if requested by Grantor. <br /> <br /> 3. The easement granted herein is non-exclusive. <br /> <br /> 4. Use of the easement by Grantee shall comply with all applicable federal, state, <br />regional and local governmental regulations. <br /> <br /> 5. Grantee hereby indemnifies and holds Grantor harmless from, for and against any <br />and all liability, loss, costs, expense, actions and/or claims, including attorneys' fees and costs, in <br />any way arising from or out of the construction, maintenance, repair, and/or use of the easement <br />or the lands described in Exhibit A, specifically included but not limited to all costs or claims <br />associated with any environmental liabilities or damages resulting from Grantee's construction <br />of improvements or exercise of the rights granted by this easement. <br /> <br /> 6. All of Grantor's conditions and reservations herein are made for itself, its heirs, <br />successors and assigns. <br /> <br /> <br />
