return the affected site to a safe and satisfactory condition, then City shall have <br />the option to perform or cause to be performed such reasonable and necessary <br />work on behalf of BFC and charge the actual costs incurred to BFC. Upon receipt <br /> <br />of a demand for payment by City, BFC shall reimburse City for such costs. <br /> 9. Construction Encroachment Permit and Fees. <br /> <br /> (a) BFC shall apply for a project specific Encroachment Permit for all <br />work within the Public Right-of-Way and any other regulatory'permits. BFC shall <br />furnish detailed plans of the work and other such information as required by the <br />Director, including a detailed map showing the layout of the proposed facilities <br />and all existing facilities located in or immediately adjacent to the area subject to <br />the Encroachment Permit, and shall pay or deposit with City all applicable costs <br />such as processing fees, field marking, plan review, engineering and inspection <br />fees related to the proposed work, and City's actual legal fees for the preparation <br />of this Agreement, prior to issuance of permit (or subsequent to work being <br />performed in the case of costs or expenses not covered by a deposit) in <br />accordance with the rates in effect at the time when work is performed.
