city councils for a majority of the cities represeming a majority of the population in the <br />incorporated area of the County; and <br /> <br /> WHEREAS, the BAAQMD is required to fund eligible projects from counties where a <br />Program Manager has been designated and an acceptable application supporting the project(s) <br />recommended by the Program Manager is received by BAAQMD; and <br /> <br /> WI-IEREAS, C/CAG has been designated, by previous resolution, as the overall Program <br />Manager for San Mateo County; and <br /> <br /> WItEREAS, on April 10, 1997, C/CAG approved projects for AB 434 funding totaling <br />$1,178,475 including $250,000 to fund the Tra~c Signal Imemonnect - El Camino <br />Real(hereinafter "Project") which is described in Exhibit MAM hereto; and <br /> <br /> WHEREAS, C/CAG determined that allocation of funding to these agencies is the most <br />appropriate and cost-effective strategy currently available within the County for reducing motor <br />vehicle emissions and is consistent with the '94 CAP and section 44241(b) of the California Health <br />and Safety Code; and <br /> <br /> VOIIgRE~, in order to comply with AB 434 and meet the requirements of BAAQMD, <br />the parties have determined to set out their mutual obligations in a formal agreemem;. <br /> <br /> NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br /> <br /> 1. Any and all Project activities undertaken by the CITYwhich are funded, in whole <br /> <br />or in part, by AB 434 funds provided under this Agreement, shall be consistent with the AB 434 <br />Funding Agreemem entered into by and between C/CAG and BAAQIVID on August 14, 1997 <br />(hereinafter "Funding Agreement"), and shall be conducted in a manner which enables C/CAG <br />to meet its obligations as Program Manager, as specifically set forth in Section 2 of the Funding <br />Agreement.
