?IQO0 98 D022 <br /> <br /> SECTION 6 INDEMNITY CLAUSES <br /> <br />1. It is agreed that County shall defend, hold harmless, and indemnify the City, its Council, <br /> officers, agents and/or employees from any and all claims for injuries and/or damages to <br /> persons and/or property which arise out of the terms and conditions of this Agreement and <br /> which result from negligent or intentional acts and/or omissions of said County, its Board, <br /> officers, agents and/or employees. <br /> <br />2. It is further agreed that the City shall defend, hold harmless, and indemnify the County, its <br /> Board, officers, agents and/or employees from any and all claims for injuries and/or <br /> damages to persons and/or property which arise out of the terms and conditions of this <br /> Agreement and which result from the negligent or intentional acts and/or omissions of the <br /> City, its Council, officers, agents and/or employees. <br /> <br />3. In the event of concurrent negligence of the County, its Board, officers, agents and/or <br /> employees, and the City, its Council, office, rs, agents and/or employees, the liability for any <br /> and all claims for injuries and/or damages to persons and/or property which arise out of the <br /> terms and conditions of this Agreement shall be apportioned under the California theory of <br /> comparative negligence as presently established, or as may herea/~er be modified. <br /> <br /> <br />
