N. The Architect shall assist the Owner as directed in preparing Supplemental <br /> Instructions with supporting documentation and data if deemed necessary by the <br /> Architect, for the Owner's approval and execution in accordance with the Contract <br /> Documents, and may authorize minor changes in the Work, not involving an <br /> adjustment in the Contract Sum or an extension of the Contract Time which are <br /> not inconsistent with the intent of the Contract Documents. <br /> <br />O. Inspection shall consist of visual observations of materials, equipment, or <br /> construction work for the purpose of ascertaining that the work is in substantial <br /> conformance with the Contract Documents and design Intent. Such inspection <br /> shall not relieve the CM/GC in any way from his obligations and responsibilities <br /> under the Contract Documents. The Architect will prepare a written report of all <br /> project site visits. <br /> <br />P. The Architect shall interpret and decide matters concerning performance of the <br /> Owner and CM/GC under the requirements of the Contract Documents on written <br /> request of either the Owner or CM/GC. The Architect's response to such requests <br /> shall be made with reasonable promptness and within any time limits agreed <br /> upon. The Architect will notify the Owner in writing of issues or efforts that may <br /> be beyond the Architect's scope of work. <br /> <br />Q. Interpretation and decisions of the Architect shall be consistent with the intent of <br /> and reasonably inferable from the Contract Documents and shall be in writing or <br /> in the form of drawings. When making such interpretations and initial decisions, <br /> the Architect shall endeavor to secure faithful performance by both Owner and <br /> CM/GC, shall not show partiality to either, and shall not be liable for results of <br /> interpretations or decisions so rendered in good faith and in accordance with <br /> accepted professional standards. <br /> <br />R. The Architect's decision on matters relating to aesthetic effect which are not <br /> expressly set forth in the Contract Documents are not final until reviewed by the <br /> Owner. <br /> <br />S. The Architect shall render written opinions within a reasonable time on all claims, <br /> disputes or other matters in question between the Owner and CM/GC relating to <br /> the execution or progress of the Work as provided in the Contract Documents. <br /> <br />T. Design team will perform one punch list inspection. The Architect only will <br /> follow-up with one back check inspection for the Design Team. All subsequent <br /> inspections requested by the CM/GC Team or the Owner, to verify contractor <br /> compliance with contract documents, will be provided by the Design Team as an <br /> additional service back-chargeable to the CM/GC Team. The architect will <br /> clearly define this requirement within project specifications.
