FXS:djk 08/22/96R {033/70) <br /> <br /> aggregate <br /> <br /> ConCurrently with the execution of this Agreement, Architect <br />shall furnish City with certificate and copies of information or <br />declaration pages of the insurance required hereunder and, with <br />respect to evidence of commercial general liability and <br />automobile liability insurance coverage, original endorsement: <br /> <br /> (a) Precluding cancellation before the expiration of <br /> thirty (30) days after City shall have received <br /> written notification of cancellation by first <br /> class mail; <br /> <br /> (b) Providing that Architect's insurance shall apply <br /> separately to each insured against whom claim is <br /> made or suit is brought, except with respect to <br /> the limits of the insurer's liability (cross <br /> liability endorsement); <br /> <br /> (c) Naming the City of Redwood City, its Council, <br /> officers, boards, commissions, employees and <br /> agents, as additional insureds; and <br /> <br /> (d) Providing that Architect's insurance coverage <br /> shall be primary insurance with respect to City, <br /> its Council, officers, boards, commissions, <br /> employees and agents, and any insurance or <br /> self-insurance maintained by City for itself, its <br /> Council, officers, boards, commissions, employees <br /> or agents shall be excess of A~hitect's insurance <br /> and not contributory with it. <br /> <br /> 13. COVENANT AGAINST CONTINGENT FEES. Architect hereby <br />declares that Architect has not employed or retained any company <br />or person, other than a bona fide employee working for Architect, <br />to solicit or secure this Agreement, and Architect has not paid <br />or agreed to pay any company or person, other than a bona fide <br />employee, any fee, commission, percentage, brokerage fee, gift or <br />any other consideration, contingent upon or resulting from the <br />award or formation of this Agreement. For breach or violation of <br />this declaration, City shall have the right to annul this <br />Agreement without liability, or at City's discretion, to deduct <br />7 <br /> <br /> <br />
