Contractor shall pedorm eve~ing requir~ to be perform, shall provide and ~ish all of ~e labor, equipment, materials, ~d tools to perform, wi~in One Hundred Thi~y (130) calendar days after ~e NOTICE TO PROCEED, ~e following work: DO~TO~ ST~ET LIGHTING PRO,CT in strict accord~ce wi~ the Plans, Contract Documents and Specifications per~ining thereto ~d signed by ~e City Engineer of Redwood City, which Documents are inco~orat~ herein and made a part of ~is Agreement as if herein ~lly set fo~. 2. Ci~ shall pay to Contractor, as ~11 consideration for the fai~l perform~ce by Contractor of ~e aforementioned work, ~e amount of Four Hundred For~-five Thousand Six Hundred Eighty-one andNo/100 Dollars ($~5,681.00) computed in accordance wi~ Contractor's accept~ Proposal dated May 7, 1997, which accept~ Proposal is inco~orated herein by reference ~ereto as if herein fully set for~. 3. All of ~e work to be done shall be done under ~e direction and supe~ision of, and to · e approval of, City or its au~orized representative, and ~e work shall be done in ~e best wor~like ma~er, confo~ing stric~y to ~e provisions of ~e specifications and plus made ~ereof. 4. (a) Contractor shall comply wi~ ~1 applicable provisions of Section 1810 to 1815, inclusive, of ~e Califo~ia Labor Code rela~ng to wor~ng hours. Contractor shall, as a pe~l~ to Ci~, forfeit TwenW five and No/100 Dollars ($25.00) for each worker employ~ in ~e execution of the Contract by Contractor or by any subcontractor for each calen~r day during which such worker is required or permi~ to work more ~an 8 hours in ~y one calendar day and 40 hours in any one calendar week, unless such worker receives compensation for all hours Worked in excess of eight (8) hours at not less ~an 1-1/2 times ~e basic rate of pay. (b) ~rsu~t to ~e provision of C~ifo~ia Labor Code, Sections 1770 et seq. Contractor and any subcon~actor under him shall pay not less ~ the prevailing rate of per diem wages as determin~ by ~e Director of ~e C~ifo~ia Depar~ent of Indus~ial Relations. ~rsu~t to ~e provisions of Califo~ia Labor Code Section 1773.2, Contractor is hereby advised that copies of ~e prev~ling rate of per diem wages ~d a general prevailing rate for holidays, Saturdays ~d Sun~ys ~d overtime work in · e localiW in which ~e work is to be perfo~ed for each craft, classification, or Wpe of worker requir~ to execute ~e Contract, are on file in the office of ~e City Clerk, which copies shall be made available to any interest~ parW on request. Contractor shall post a copy of s~d prev~ling rate of per diem wages at each job site.
