' DUPL.ICATE ORIGINAL <br /> FIRST AMENDMENT TO MAY 27,1997 LEASE <br /> OF REDWOOD CITY MAINTENANCE FACILITY AT 1400 RADIO ROAD <br /> TNIS FIRST AMENDMENT (First Amendment) to the May 27, 1997 Lease <br /> Agreement for the Redwood Gity Maintenance Facility located at 1400 Radio Road <br /> (Lease Agreement) is made effective July 1, 2014,by and between SILICON VALLEY <br /> CLEAN WATER, formerly lrnown as SOUTH BAYSIDE SYSTEM AUTHORITY, a joint <br /> exercise of powers authority (Lessor) and CITY OF REDWOOD CITY, a municipal <br /> corporation of the State of California(Lessee). <br /> Recitals <br /> A. On May 27, 1997 Lessor and Lessee entered into a Lease whereby Lessee <br /> leased from the Lessor that certain real property located at 140Q Radio Road, <br /> Redwood City,California(Properry)for a thirty-year term. <br /> B. The Lease provides that the parties may, by mutual agreement in writing <br /> approved by resolution of the parties' respective governing bodies, agree to <br /> modifications of the Lease Agreement provided that such amendments do <br /> not substantially alter or change the terms of the Agreemen� <br /> C. Lessor wishes to use a portion of the Property,depicted in Exhibit D attached <br /> hereto and hereby incorporated by reference,for vehicle access, ingress and <br /> egress. <br /> D. As consideration for such use,Lessor agrees to offset the annual rent due and <br /> payable under the Lease Agreement by two thousand dollars ($2000) per <br /> year. <br /> E. Therefore, Lessor hereby desires to enter into this First Amendment with <br /> Lessee and Lessee desires to enter into this First Amendment with the <br /> Lessor. <br /> Agreement <br /> NOW,THEREFORE,Lessor and Lessee hereby amend the Lease as follows: <br /> 1. The following sentence shall be added to the second full paragraph <br /> (Witnesseth)of the Lease Agreement: <br /> Notwithstanding the above,Lessor shall maintain the right to vehicle access, <br /> ingress and egress over the area depicted on Exhibit D, attached hereto and <br /> hereby incorporated by this reference. <br /> 2.
