MOTION Councilman Barrett moved, seconded by Councilman Biagi,
that the following findings be adopted with regard to the appeal of
Harrington-Kulakoff Development Company of the denial by the Plam m g
Commission of appllcaton to amend the Zoning Map to rezone a portion
of property adacent to Farm Hill Boulevard in the vicinity of Farm
Hill Estates No 1 and No 2
1) that with regard to any lack of conformity with the General
Plan which designates the property for employment purposes,
that the alternate development plan proposed by the developer
contains modifications which anticipates the General Plan
zoning for the area, and that, further, the modified pro-
posal also addresses itself to any lack of conformity with
the existing residential use of property in the immediate
vicimty,
2) that with regard to traffic, the modified proposal would
reduce the increased traffic which might be anticipated by
the initial proposal,
3) that there is evidence that the specific development pro-
posal for the site can address the matter of protection
of any rare and endangered plant species through use of a
Planned Development Permit,
4) that economic benefit cannot be measured only by property
tax revenues and direct evidence does not support a finding
that the proposed rezoning will not provide an economic
benefit to the City, and
5) that there is no excess sewage capacity, but the zoning
is within the capacity of the plart as planned for the City
(attachment to
Minute Order 77-229)
