4.4 2. , - <br /> MOTION. Councilman Norris moved that prior to issuance of any new GID <br /> 1-64 bonds, Redwood Shores registered voters be given a vote, with a <br /> ma,7ority of affirmative votes cast required, before the City Council <br /> can issue any new bonds. <br /> In response to quest�on, City Attorney Schricker advised that there <br /> �s no legal need to have a vote to sell the bonds under the prior 1 <br /> authorization. Mr. Schricker advised Counc�l should consider whether <br /> it would be their intention to hold�an elect�on on every GID No. 1-64 <br /> pro�ect and whether the District Board might not thus be delegating <br /> , its responsibili'ty <br /> Homeowner member of RSHA, stated he appreciates that it is important <br /> that the improvements be made and the bonds be issued, but that he <br /> believes a vote should be taken and an effort made to let Redwood <br /> Shores homeowners know of the importance of the"improvements to'them. <br /> Discussion followed concerning the responsibilities of the District <br /> Board, the t�metable for the needed improvements, the fact that the cost <br /> of any special election would be charged to the District, the'fact that <br /> c�rcumstances suggest that the improvements are so essential that it <br /> would-be necessary to �ssue the bonds even if an advisory�vote were <br /> held and the bonds re,7ected, the postion of Mobil w�th regard�to being <br /> w�lling to be guarantor under significantly changed circumstances; and <br /> the cost of delays in starting the pro�ects <br /> Councilman Barrett stated for the record that he would like to have <br /> some sort of �nformation material or questtonnaire used to poll home- <br /> owners rather than a special election City Attorney Schricker advised <br /> that informational act�vities would be satisfactory but any poll'which <br /> is essentially an election must be conducted according to the Elections , <br /> Code. , <br /> Councilman Norris stated for the record that he favors an election whose <br /> results would be binding upon the District Board <br /> Councilman Rhodes stated for the record that the only bonds presently <br /> being d�scussed are for improvement of Peninsula Parkway, the Holly <br /> Street Interchange, and a water line connection which will be needed <br /> by present residents when the agreement with BCWD expires in 1980, and <br /> that when other pro�ects are cons�dered in the future, a vote may be <br /> in order. <br /> It was suggested that lf a binding vote were held and the bonds re�ected, <br /> 'then results for the District might be disastrous ' <br /> Don Warren, Mobil (see above) stated that if a full election were set <br /> up and Mobil �s asked to remain as guarantor, they would have`to look <br /> very closely at the matter and could not now commit themselves to con- <br /> t�nuing as proposed in the Kuebelbeck report. Mr. Warren suggested <br /> that the party which is paying more than 50% of the bond'indebtedness <br /> might be expected to be allowed to participate in the vote `'° <br /> Gity Manager Fales sug9ested that Council might consider proceeding <br /> now with the �mnediately needed improvements and consitler a plebescite <br /> , later on future pro�ects He called attention to time comim tments, ' <br /> the opportun�ty to prove that the bonding mechanism works, and the <br /> fact that certain federal and state'money is now committed and avail- <br /> � able for the improvements but, if unused now, might be withdrawn <br /> , indefimtely <br /> � Study Session ' <br /> � GID No 1-64 , <br /> 11/7/77 <br /> f <br />
