; . � 227 <br /> City Manager Fales referred to the report of the Planning Commis- <br /> sion dated May 4, 1978 which had been forwarded to the Council <br /> regarding the application <br /> Robert De11�Ergo, offices in Wells Fargo Bank, Broadway and Main, <br /> indicated he represented the owner of property ad,7acent to the <br /> ' property under consideration, and was concerned with respect to <br /> effect of the type development proposed on that of his client <br /> George Flack, 30 West 39th Avenue, San Mateo, displayed a rendering <br /> of the proposed pro,7ect, as well as a schematic layout showing the <br /> area He responded to question by Council regarding apparent con- <br /> cern of the neighboring property owner with respect to a proposed <br /> retainin9 wall, referred to the drawings to show the location of <br /> the contiguous property and of the proposed 4-foot retaining wall, <br /> which he suggested would be for the protection of the ad,7oining <br /> property Additional discussion related to concerns regarding the <br /> location of guest parking and whether it would be convenient and <br /> visible from the street, and Mr Flack indicated there will be <br /> guest parking signs, and that the units are designed primarily for <br /> sin9les and couples, with double garages for each unit In response <br /> to question by Council, Planning Director Schroeter advised that the <br /> plan presently before Council was the same as that which had been <br /> denied by the Planning Commission <br /> Discussion continued with Mr Flack responding to questions by Council <br /> regarding the anticipated cost per unit of approximately $70-$73,000; <br /> that the development is not really a planned development which <br /> normally requires more acreage, that the location is close to down- <br /> town shopping, bus service and E1 Camino Real, that fewer units on <br /> ' this parcel would not be economically feasible because of high land <br /> costs In response to concern regarding lack of open space, Mr <br /> Flack advised that each unit will have a 4' x 10' deck, as well as <br /> a corrnnon green area. <br /> Rick Richardson, Terrace Realty, spoke in support of the development <br /> as a condominium, as opposed to an apartment house such as are <br /> presently in the area <br /> Robert Dell'Ergo (see above) advised that he represents Mrs Babuin, <br /> owner of the ad,7oining property, and referred to a diagram depicting <br /> his client's property, having 150 feet on Brewster by 50 feet along <br /> Arguello Street, and noting that the property had been zoned CN <br /> (Neighborhood Commercial) which allows development to the lot line, <br /> then rezoned to residential, requiring a 15-foot setback He stated <br /> that their concern was with regard to the effect on the neighboring <br /> property if an underground garage is built, and asked that if the <br /> application is allowed, there be a requirement that any retaining <br /> wall be engineered so that it would be substantial enough so as to <br /> not be affected by their reasonable trenching on the other side of <br /> the property line <br /> City Attorney Schricker advised in response to questions by Council <br /> that, to characterize the situation that by approving the application <br /> the ad,7acent property is ,7eopardized is erroneous, and that with <br /> ' respect to consideration of the proposal of the ad,7acent property <br /> owner, which has not been presented to the City, places it in a <br /> position of grappling with something that does not exist. He pointed <br /> out that what Council should be addressing itself to is the planned <br /> - 3 - Reg Mtg <br /> 5/22/7H <br />
