Bren <br /> Co , asked that the public hearing relating to the PDP Application <br /> of his company be continued only one week until May 3, 1976, if <br /> the hearing is to be continued, stating that delay in approval of <br /> the application could result in some hardship for his company <br /> In response to suggestion of Counci'lman Rhodes that Council could, <br /> commence the public hearing now on the PDP Application and that the <br /> two absent Council members could vote on the matter later,��f- <br /> necessary, by listening to the tape recording of the meeting 2n <br /> order to inform themselves on the discussion at the hearing, <br /> Assistant City Attorney Maloney advised such action is not usually <br /> taken unless it is done under the doctrine of necessity and that, <br /> ordinarily, Council members cannot rehabilitate themselves,by � <br /> listening to a tape recording He further noted that absent <br /> Council members could vote if a hearing was continued and .thus, <br /> no testimony was received at a particular hearing <br /> The motion failed for lack of a second <br /> MOTION Councilman Barrett moved, seconded by Councilman,Bury, <br /> to continue the public hearing relating to'the creation of a PF, , <br /> (Public Facility) District to May 10, 1976 <br /> The motion carried unanimously by voice vote <br /> (MINUTE ORDER NO 76-102) <br /> Discussion followed concerning whether or not it is desirable to <br /> delay consideration of matters because of the absence of Council- <br /> members, whether the nature of an Agenda item might not suggest <br /> the desirability of having a full Council present in certain in- <br /> stances, and the desire of Council to be fair to Council members <br /> who must be absent and to the community as well as to developers ' <br /> and others presenting items which require hearings ' <br /> MOTION Councilman Barrett moved to continue the public hearing, � <br /> relating to the PDP Application of Donald L Bren Co to May 10, ' <br /> 1976 <br /> The motion failed for lack of a second F <br /> MOTION Councilman Bury moved, seconded by Councilman Barrett, to � <br /> continue the public hearing relating to the Planned Development � <br /> Permit Application of Donald L Bren Co to May 3, 1976 � •' <br /> ! <br /> The motion carried on the following roll call vote �} <br /> . +i <br /> Ayes Councilmen Barrett, Bury and Mayor Leipzig <br /> Noes Councilmen Biagi, Rhodes � <br /> (MINUTE ORDER NO 76-103) <br /> -3- <br /> Rey Mtg ` <br /> 4/76/76 ,' <br /> , <br /> , �,�,.. , .. , „ . ,,.. . , .. . .. - — <br />
