He atated that both eides of the <br /> petition bad been.heard and that the Planning Commission had voted to reoom- <br /> ' mend against any chan�e in zoning, Councilman Armetrong atated he had been <br /> present at the meeting oY the Planning Commiseion at whioh time this matter <br /> had been presented and that it wae his underetanding that the Planning Oom- <br /> mieaion wa,s reluctant to make any change in zoning at thie time when was <br /> ' Yelt tha.t when the master plan was adopted it would be rezoned from business <br /> to industrisl if the petition was favorably acted upon at tnia time. Mr. <br /> Larroury, aitorney 4or Mr. Banta,.appeared in hie beha.lf so that Mr, Ba.nta <br /> would be allovred to continue to operate hie upholetery.businesa which he <br /> wae now conducting in niolation of the zoning ordinance. Councilman Andereon <br /> believed the Banta abatement proceedings,ahould be oarrled on the a,�enda <br /> � until euch time ae a final determination ie made ae to the zone thie property <br /> is to be in. Councilman Fletoher moved,'seconded by Councilman Andereon, <br /> that the Hanta abatement proceedings be carried on the agenda until the firat <br /> meeting in June, Oouncilman Armstrong advised he wae going to oote ia the <br /> negative due to the fact that he dieapproned oY knowingly permitting a will- <br /> ful violation of the ordinance and at the same time engage a maeter planner <br /> ' to plan the city. He said the very exietence of a zoning ordinance required <br /> that .the Counail observe it and tha.t it was fundamental to a zoning ordinance <br /> that it would hurt aomeone, As a matter of principle, he vcas going to note <br /> againet continuing the abatement proceedings. The motion passed vrith Qounoil- <br /> man Armatrong voting in the negative. <br /> Councilman Fletcher moved that the abatement proceedinge againet the Rice property <br /> on Edgewood Road be continued to the first meeting in June due to the ecar- <br /> city oY homes, The motion.wae seconded by Councilman MeNulty, Counoilman <br /> • Armstrong again etated he was going to.vote in the negative for the eame <br /> reason as he advanced in the Banta abatement proceedinge. The motion paeeed <br /> with Councilman Axmstrong voting in.the negative, <br /> Planning Qommieeion recommendation No. 3: Recanmended denial of petition of L. 9Y, <br /> Trambley to raise chlckene commercially on a portion of Lot-6 in Hlock D oY <br /> ' Woodelde Acres No. 1(1442 Gordon Street). Councilman Axmstrong moved, seoond- <br /> ed by Councilman Britseh�i, that�the recommendation of the Planning Commiss•ion <br /> be accepted. Under the question, Councilman Granger asked if this was not the <br /> Sentfield area-and wae under the impreeeion that the Counoil had some years <br /> ' ago voted to a,llow commercial ohiCken raieing in this area even though it wae <br /> in the second residential district.
