there is not substantial evidence that the Franklin Street Project will have a <br />significant effect on the environment; and <br /> <br /> WHEREAS, the Agency caused to be prepared, circulated and made <br />available to members of the public for comment and thereafter, by Resolution <br />No. RD -99-22, adopted the Franklin Street Replacement Housing Plan in <br />accordance with Section 33413.5 of the Health and Safety Code; and <br /> <br /> WHEREAS, Shea is committed under the terms of the DDA to <br />contribute affordable housing units in satisfaction of the Community <br />Redevelopment Law (California Health and Safety Code Section 33000 <br />et seq. ,"CRL"), CEQA and the Replacement Housing Plan; and <br /> <br /> WHEREAS, the DDA provides that in return for Shea's performance <br />the Agency shall attempt to acquire by negotiation or, if unable to do so, shall <br />consider acquiring by eminent domain certain parcels or portions thereof <br />located within the Project Site (the "Acquisition Parcels") and, thereafter, <br />convey the Acquisition Parcels to Shea; and <br /> <br /> WHEREAS, the Agency has made available copies of the DDA to <br />members of the public for comment and held a duly noticed public hearing <br />on the DDA in accordance with Section 33431 of the California Health and <br />Safety Code; and <br /> <br /> WHEREAS, the Agency has reviewed and considered the DDA, a copy <br />of which is on file at the office of the Agency's Secretary at 1017 Middlefield <br />Road, Redwood City, California, together with the Report of the Agency staff <br />to the Agency on the DDA. <br /> <br /> NOW, THEREFORE, THE AGENCY DOES HEREBY RESOLVE AS <br />FOLLOWS: <br /> <br /> That certain agreement entitled "Disposition and Development <br />Agreement for Franklin Street Project" by and between Shea Homes Limited <br /> <br /> 2 RD 99-31 <br /> Shea DDA RD 99- <br /> AK/DES: 8/29/99 <br /> <br /> <br />
