ATTACHMENT N0. 10 <br /> CERTIFICATE OF COMPLETION <br /> THIS CERTIFICATE OF COMPLETION ("Certificate") certifies that IRVINE <br /> APARTMENT COMMLJNITIES, L.P., a Delawaze limited partnership (the "Developer"), has <br /> complied with all terms and conditions contained in that certain document entitled Disposition <br /> and Development Agreement, dated , 1999 ("DDA"), by and between the <br /> REDEVELOPMENT AGENCY OF THE CITY OF REDWOOD CITY (the "Agency") and the <br /> Developer goveming the Developer's obligations to construct the Project Phase described herein. <br /> The development described in the DDA is thus hereby deemed complete and accepted in all <br /> respects by the Agency, within the meaning of Section 517 of the DDA, and neither the Agency <br /> nor any other person shall have any right, remedy or control pursuant to the DDA hereafrer, <br /> including without limitation any right to reenter the propeRy or revest in the Agency the estate <br /> conveyed to the Developer or exercise any other rights provided in Section 810 of the DDA. <br /> Furthermore, the encumbrance created by the following language: <br /> "The Grantor has the limited and conditional right to the retum of title <br /> and possession of the Property and all improvements thereon, and to the <br /> termination and revesting in the Grantor of the estate conveyed to the Granfee <br /> hereby, as such right is set forth in Section 810 of the Agreement; provided that <br /> such right to reenter, take possession, terminate and revest in connection with a <br /> Project Phase shall expire and be of no further force or effect upon the <br /> recordation by the Grantor of the Certificate of Completion for such Project <br /> Phase." <br /> appearing in the deed from the Agency to the Developer, recorded in the Office of the Recorder <br /> of the County of San Mateo on as Document No. (the <br /> "Grant Deed") is hereby removed. <br /> 9627:9833L2 - � . -�� <br />
