The Redevelopment Agency Board finds that although the Initial Study identifies several potentially <br />significant environmental effects, (i) the applicants have accepted City- or Redevelopment Agency- <br />imposed conditions of approval or have agreed to modify the Project so as to reduce these impacts to a <br />point where clearly no significant effect on the environment would occur, and (ii) there is no substantial <br />evidence in light of the whole record before the Redevelopment Agency Board that the Project as <br />revised, may have a significant effect on the environment. If impacts are not considered significant but <br />mitigation is provided anyway, this is so stated. After reviewing the public record, as composed of the <br />aforementioned elements, the Redevelopment Agency hereby makes the following findings regarding <br />the significant effects of the proposed Project. <br /> <br />1. Pursuant to Public Resources Code §21082.1(c)(3), the Redevelopment Agency Board finds that the <br /> Mitigated Negative Declaration reflects the Redevelopment Agency Board's independent judgment. <br /> <br />2. Pursuant to Public Resources Code §21091(f), the Redevelopment Agency Board has considered <br /> the Mitigated Negative Declaration together with any comments that were received during the <br /> public review period on the Mitigated Negative Declaration. <br /> <br />3. Pursuant to Public Resources Code §21167.6, the documents and other materials which constitute <br /> the record of proceedings upon which the Redevelopment Agency Board's decision is based are <br /> located at the City of Redwood City Redevelopment Agency, 1017 Middlefield Road, Redwood <br /> City, California, 94064. <br /> <br />4. Pursuant to Public Resources Code §21094 and CEQA Guidelines §15152, the Redevelopment <br /> Agency Board has relied on tiering to evaluate the significant environmental effects related to the <br /> Project, and determined that the Project is: (i) consistent with the plans for which the prior <br /> Redevelopment and Franklin Street Area Plan EIRs were prepared and certified; (ii) is consistent <br /> with applicable City of Redwood City land use plans and zoning; and (iii) is not subject to Public <br /> Resources Code §21166; and has utilized the Redevelopment EIR, the Franklin Street Area Plan <br /> EIR and Franklin Street Project Initial Study and Mitigated Negative Declaration in making such <br /> determinations. <br /> <br />5. Pursuant to Public Resources Code §21166 and C EQA Guidelines § 15162, the Redevelopment <br /> Agency Board finds that (i) the Project approvals implement the Redevelopment Plan for <br /> Redevelopment Project Area No. 2 and the Franklin Street Area Plan and do not result in <br /> substantial changes in the Project which would require major revisions to the prior EIRs due to the <br /> involvement of new significant environmental effects or in substantially more severe effects; (ii) <br /> there are no substantial changes in circumstances under which the Project is being undertaken <br /> which require major revisions to the Redevelopment EIR and Franklin Street Area Plan EIR due to <br /> the involvement of new significant environmental effects or in substantially more severe effects; <br /> and (iii) there is no new information of substantial importance that shows that the Project would <br /> have one or more significant effects not evaluated in the Redevelopment EIR and Franklin Street <br /> Area Plan EIR, or in substantially more severe effects, or that indicate that there were mitigation <br /> measures which were rejected by the applicants. <br /> <br />The following findings set forth the basis for and analysis supporting the Redevelopment Agency <br />Board's decision to adopt a Mitigated Negative Declaration for the Project. <br /> <br />AESTHETICS (Section I) <br /> <br />FRANKLIN STREET PROJECT -6- Findings <br /> RD99-21 <br /> <br /> <br />
