E. - Page 3 <br /> AMENDMENT NO. 5 <br /> TO REVOCABLE PERMIT <br /> FOR CHILDCARE PROVIDER AT SANDPIPER COMMUNITY CENTER <br /> (CHILDREN'S CREATIVE LEARNING CENTER, INC.) <br /> This permit ("Amendment No. 5") is entered into and effective as of the day <br /> of , 2011, by and between the City of Redwood City, a charter city and <br /> municipal corporation of the State of California ("City"), and the Children's Creative <br /> Learning Center, Inc. ("Permittee") (collectively, the "Parties") for providing child care <br /> services at the Sandpiper Community Center. <br /> RECITALS <br /> A. The Parties previously entered into a permit entitled "Grant of Revocable Permit <br /> Child Care Provider at Sandpiper Community Center", dated August 17, 1998 <br /> (the "Original Permit"); and <br /> B. The Original Agreement was previously amended by Amendment No. 1 dated <br /> July 12, 2005, Amendment No. 2 dated August 6, 2008, Amendment No. 3 dated <br /> September 24, 2009, and Amendment No. 4 dated September 10, 2010. The <br /> Original Permit and all previous amendments are collectively referred to herein <br /> as the "Perm it"; and <br /> C. Permittee continues to meet the terms and conditions of the Permit; and <br /> D. The Permit allows an annual increase in the Monthly Fee by up to five percent <br /> (5%), and the Monthly Fee was last increased in 2010 by 5% through <br /> Amendment No. 4; and <br /> E. The City now desires to increase the Monthly Fee by five percent (5%) or Two <br /> Hundred and Twelve Dollars and Seventy-One Cents ($212.71), for a total <br /> Monthly Fee of Four Thousand Four Hundred Sixty-Six Dollars and Ninety-eight <br /> Cents ($4,466.98). <br /> NOW, THEREFORE, in consideration of the recitals and the mutual covenants <br /> contained herein, the Parties agree as follows: <br /> 1. Commencing on September 1, 2011, the first sentence of Section 8 of the <br /> Permit entitled "Monthly Fee" is hereby amended to read as follows: <br /> "Permittee shall pay City, at 1017 Middlefield Road, Redwood City, <br /> CA 94063, in advance, the sum of Four Thousand Four Hundred Sixty-six <br /> Dollars and Ninety-eight Cents ($4,466.98) per calendar month (the <br /> "Monthly Fee")." <br /> 2. All other terms of the Permit which are not in conflict with the provisions of <br /> ATTY/AGR/2011/AMENDMENTS/AMEND N0.5CCLC <br /> 072911 1 <br />
