B. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> August 22, 2011 <br /> SUBJECT <br /> Final Acceptance of Work Completed During Amendment One of the Cost Shared <br /> Sidewalk Repair Project and Issuance of Amendment Two for the Cost Shared <br /> Sidewalk Repair Project <br /> RECOMMENDATION <br /> 1. By motion, approve the work completed during Amendment One of the Agreement for <br /> Cost Shared Sidewalk Repair Project by SpenCon Construction, Inc. of Danville, CA. <br /> 2. Authorize the release of the bonds and the Retention withheld during the course of <br /> work in accordance with City procedure <br /> 3. By motion, approve issuance of Amendment Number Two to the Agreement for Cost <br /> Shared Sidewalk Repair Project with SpenCon Construction Inc. of Danville, CA in the <br /> amount of $140,000.00 and authorize the City Manager to increase the contract <br /> amount, if necessary, up to 10% of the amount awarded <br /> BACKGROUND <br /> On July 27, 2009, the City Council awarded the 2009-2010 Cost Shared Sidewalk <br /> Repair contract to SpenCon Construction Inc. of Danville, CA for their bid of <br /> $241,025.00. The original agreement includes the option for four (4) extensions using <br /> relevant fluctuations in the Construction Cost Index for the San Francisco Bay Area as <br /> listed in the Engineering News Record to adjust bid item amounts by a maximum of five <br /> percent. On September 27, 2010 the City Council authorized execution of Amendment <br /> Number 1 to the Agreement in the amount of $244,230.00. The construction of <br /> improvements has been completed in accordance with the Agreement, the plans and <br /> specifications, and to the satisfaction of City staff. Therefore City staff recommends that <br /> Council accept the improvements, release retention in the amount of $25,374.00 and <br /> release the performance bond and labor and material bond according to City <br /> procedures. <br /> The work completed during Amendment One included installation of 12 ADA curb <br /> ramps, replacement of sidewalk, curb and gutter and driveway areas. Work was <br /> performed at approximately 60 residential locations and at 22 commercial locations. <br /> The work to be done during Amendment Number 2 will be of the same nature as the <br /> work done during the term of the initial Agreement and Amendment Number 1. Repairs <br /> will be made to various sidewalks, curbs and gutters throughout the city and ADA curb <br /> ramps will be constructed at street corners when sidewalk work is being performed at <br />
