6.1. C. - Page 28 <br /> 16.9.1.2 to care for the spouse, domestic partner, child or parent of the employee who <br /> has a serious health condition; <br /> 16.9.1.3 if the employee is unable to perform his/her job because of the employee's own <br /> serious health condition. <br /> For purposes of this section the definition of: child means a biological, adopted, or foster child, <br /> stepchild, legal ward, or a child of a person standing "in loco parentis" (in the place of a parent, <br /> or a parent's authority, who is under 18 years of age or older and incapable of self-care because <br /> of inental or physical disability; spouse/domestic partner as defined or recognized under state <br /> law; parent is a biological or adoptive parent or a person who stood "in loco parentis" to an <br /> employee when the employee was a child (parent-in-law does not quality). <br /> 16.9.2 When an employee desires leave for the above stated reasons, the employee should give 30 <br /> calendar days written advance notice to his/her immediate supervisor (or if the event is <br /> unforeseeable employee should give as must notice as possible). <br /> The City may require that a request for family leave be supported by a certification issued by the <br /> employee's health care provider. <br /> Certification may also be required from the health care provider of the employee's child, parent <br /> or spouse who has a serious health condition before the employee is approved to use <br /> family/medical leave to take care of that family member. <br /> Failure to comply with the above requirements may lead to denial of leave. <br /> 16.9.3 The employee may elect, or the City may require the employee, to substitute accrued vacation <br /> leave or other accrued time off during family/medical leave. Sick leave may be used during the <br /> period of family/medical leave in accordance with the provisions of the Plan. <br /> 16.9.4 The City will maintain contributions for the employee's health benefits under group health plans at <br /> the same level as prior to the leave, in accordance with the Family & Medical Leave Act. The <br /> employee may return to the same position, or another position with equivalent benefits, pay and <br /> other terms and conditions of employment upon completion of the leave. <br /> 16.10 Court Appearance Leave <br /> Leave for court appearance shall be granted by the City for court appearance on behalf of the City with no <br /> loss of salary. <br /> 16.11 Personal Business Leave <br /> 16.11.1 Personal Business is defined as business of urgent and compelling importance which cannot be <br /> taken care of outside of normal working hours and which is not covered under other leave <br /> provisions of this Memorandum of Understanding. <br /> 16.11.2 An employee shall be entitled to a maximum of two (2) days per year for Personal Business <br /> Leave for any reason without loss of pay. Such leave shall be deducted from accrued sick leave. <br /> 21 <br />
