(r) In consideration of the findings set forth in subdivisions (e) - (q) above, concurrently <br /> herewith, this Council has adopted that certain ordinance entitled, "Ordinance Adding <br /> Chapter 18B to the Code of the City of Redwood City Relating to Sexually Oriented <br /> Businesses." References herein to "this ordinance" shall be deemed to apply to this <br /> ordinance, adding Article 27 to Ordinance No. 1130, as amended, the aforesaid ordinance <br /> adding Chapter 18B to the Code of the City of Redwood, or to both such ordinances, <br /> depending upon the context. <br /> <br /> SECTION 2. AMENDMENT. ARTICLE 27 is hereby added to Ordinance No. 1130, as <br /> amended, the Zoning Ordinance of the City of Redwood City to read as follows: <br /> <br /> "ARTICLE 27. SEXUALLY ORIENTED BUSINESSES. <br /> <br /> Section 27.1. Purpose. To prevent community wide adverse economic impacts, increased <br />crime, decreased property values, and the deterioration of neighborhoods caused by the <br />concentration of sexually oriented businesses in close proximity to each other or to incompatible <br />uses such as schools, churches, public parks, and residentially zoned districts or residential uses, <br />irrespective of the zoning districts within which such uses are located; further, to prevent the <br />concentration of sexually oriented businesses or the location thereof in close proximity to the <br />aforesaid zoning districts or uses, but also to permit the location of sexually oriented businesses in <br />certain areas of the City under reasonable time, place, and manner regulations protective of both <br />freedom of expression and property rights. <br /> <br /> Section. 27.2. Definitions. <br />(a) Establishment of a sexually oriented business. As used herein, to "establish" a sexually <br /> oriented business shall mean and include any of the following: <br /> <br /> (1) The opening or commencement of any sexually oriented business as a new business; <br /> (2) The conversion of an existing business, whether or not a sexually oriented business, <br /> to any sexually oriented business defined herein; <br /> (3) The addition of any of the sexually oriented businesses defined herein to any other <br /> existing sexually oriented business; or <br /> (4) The relocation of any such sexually oriented business. <br /> <br /> (b) Specified anatomical areas. As used herein, "specified anatomical areas" shall mean and <br /> include any of the following: <br /> <br /> (1) Less than completely and opaquely covered human genitals or pubic region; <br /> buttocks; and female breast below a point immediately above the top of the areola; <br /> (2) Human male genitals in a discernibly turgid state, even if completely and opaquely <br /> covered; <br /> (3) Any device, costume or covering that simulates any of the body parts included in <br /> subdivisions (1) or (2) above. <br /> <br /> 1130.298 <br /> 5 <br /> <br /> <br />
