B. It is agreed tha~ any monthly billings invoiced to STATE for CITY owned and <br /> maintained lighting will be based on actual costs derived from utility company <br /> billings. CITY will bill STATE for any STATE share of Electrical Facilities <br /> expenses as shown in Exhibit A. <br /> <br /> IV Exhibit A will be amended as necessary by written concurrence of both parties to <br /> reflect any future changes to the described Electrical Facilities and the power system. <br /> <br /> V STATE costs and expenses assumed under the terms of this Agreement are <br /> conditioned upon the passage of the annual State of California Budget by the <br /> Legislature, the allocation of funding by the California Transportation Commission as <br /> appropriate, and the encumbrance of funding to the District Office of STATE to pay <br /> any CITY billings. <br /> <br /> VI This Agreement shall remain in full force and effect until amended by the mutual <br /> consent of the parties or terminated by either party upon thirty (30) days' notice to <br /> the other party. <br /> <br /> IN WITNESS WHEREOF, the parties hereto have set their hands and seals the day and year first <br /> above written. <br /> <br /> CITY OF REDWOOD CITY STATE OF CALIFORNIA <br /> DEPARTMENT OF TRANSPORTATION <br /> <br /> Mayor JEFF MORALES <br /> Director <br /> <br /> Approved as to <br /> From and Procedure: <br />  /k, GLENN E.
