6. 1. F. - Page 48 <br />responsible. Any damage caused by entry under this subsection shall repaired by the Declarant. This <br />right of entry includes, but is not limited to, entering into one Unit to perform work which benefits <br />another Unit(s). Unless otherwise specified in the initial grant deed of the Condominium Unit from <br />Declarant, this right of entry shall automatically expire eleven (11) years from the last close of escrow for <br />the sale of a Condominium in the Development. <br />Section 6.8 Annexation of Annexation Property Subject to the terms of any Declaration <br />of Annexation for a future Phase, once additional property is annexed into the Development as described <br />in a Declaration of Annexation, the Units and the Owners of Units in the annexed property shall have all <br />of the rights and easements specified in this Article, and the Units and the Owners in the Development <br />prior to annexation shall have all of the easements specified in this Article as though the annexed Phase <br />were initially part of the Development. <br />Section 6.9 Public Easements There shall be easements over portions of the Property and <br />Development in favor of the general public or government agency as shown and described on the Parcel <br />Map, the Condominium Map, as required by the City of Redwood City or other governmental agency, <br />and as may be declared, reserved or agreed upon by Declarant as provided in this Declaration, a <br />Declaration of Annexation or other document. <br />ARTICLE 7 <br />USE RESTRICTIONS <br />In addition to all of the conditions and covenants contained herein, the use of the Development <br />and each Unit therein is subject to the following restrictions: <br />Section 7.1 Residential Use No Condominium shall be occupied and used except for <br />residential purposes by the Owners, their tenants, and guests, and no trade or business shall be conducted <br />in any Condominium, except that Declarant, its successors or assigns, may use any Condominium or <br />Condominiums in the Development owned by Declarant for a model home site and display and <br />sales /construction /customer service office during construction and until the last Condominium is sold by <br />Declarant. A Condominium may have a typical home office, provided that (i) such use does not interfere <br />with the quiet enjoyment by other Condominium Owners of their Condominiums, (ii) there is no signage <br />visible from the exterior of the Unit, and (iii) such use does not include visiting clients or employees. <br />(a) No health care facilities operating as a business or charity shall be permitted in <br />the Development. <br />(b) No family day care center shall be permitted within the Development except as <br />specifically authorized by Health and Safety Code §1597.40 and other applicable state statues. The <br />owner /operator of any such day care facility shall comply with all local and state laws regarding the <br />licensing and operating of a day care center and, in addition, shall: <br />(1) Name the Association as an additional insured on the liability insurance <br />policy or bond carried by the owner /operator of the day care center; <br />(2) Defend, indemnify and hold the Association harmless from any liability <br />arising out of the existence and operation of the day care center; <br />(3) Abide by and comply with all of the Association's Rules; <br />3S <br />CCRS -One Marina. doex <br />
