6.1.F. - Page 11 <br />DECLARATION <br />OF <br />COVENANTS, CONDITIONS AND RESTRICTIONS <br />ESTABLISHING A PLAN FOR CONDOMINIUM OWNERSHIP <br />OF <br />ONE MARINA, <br />A CONDOMINIUM PROJECT <br />This Declaration of Covenants, Conditions and Restrictions Establishing a Plan for Condominium <br />Ownership of One Marina (the "Declaration ") is made on the date hereinafter set forth by the undersigned <br />(the "Declarant ") and is made with specific reference to the following facts: <br />A. Declarant is the owner of a certain tract of land located in the City of Redwood City, <br />County of San Mateo, State of California (the "Property ") which is shown and described on that certain <br />subdivision map entitled Parcel Map No. 2011 -02 (the "Parcel Map ") which was recorded on June 27 <br />2011, in Book 79 of Parcel Maps, at Pages 90 through 92, inclusive, in the Official Records of the County <br />of San Mateo, State of California (the "Official Records "). The Parcel Map subdivides the Property into <br />four parcels: Parcel 1, Parcel 2, Parcel 3 and Parcel 4. <br />B. Parcel 2 shown on the Parcel Map has been further subdivided for condominium <br />purposes by that certain subdivision map entitled Final Map of One Marina for Condominium Purposes <br />(the "Condominium Map ") which was recorded on [ 20[ _], as Instrument No. <br />I 1 in the Official Records. <br />C. Declarant intends to develop portions the Property as a Common Interest Development <br />which shall be a condominium project as defined in California Civil Code Section 1351(f). The <br />Development is intended to be created in conformity with the provisions of the Davis - Stirling Common <br />Interest Development Act (Civil Code Section 1350 et seq.), which provides that a condominium shall <br />consist of an undivided interest in common in a portion of real property coupled with a separate interest in <br />space called a unit. <br />D. Declarant intends by this Declaration to impose upon portions of the Property these <br />mutually beneficial restrictions, easements, assessments and liens under a general plan of improvement <br />and development for the benefit of all of the Owners, the Units and the Common Area within the <br />Development. <br />E. The Property is intended to be developed in two or more Phases. The first Phase (Phase <br />1) will be subject to this Declaration upon its recordation. Each subsequent Phase will be subject to this <br />Declaration upon the recording of a Declaration of Annexation applicable to each such Phase as provided <br />in Section 2.8 of this Declaration. Declarant may, but has no obligation to, annex all or any portion of the <br />Annexation Property or other portion of the Property to the Development by recording a Declaration of <br />Annexation in compliance with the provisions of this Declaration. Phase 1 will include those portions of <br />the Property described in Section 2.1 of this Declaration and as indicated as part of Phase 1 on the <br />Condominium Plan (defined in Section 1.1 below). Future Phases intended to be annexed into and <br />become part of the Development are portions of the Property referred to herein as the Annexation <br />Property, as further described in Section 1.1 of this Declaration and shown on the Condominium Plan. <br />F. The Owner of a Condominium will receive a separate interest in an individual Unit and <br />an undivided interest in common in the Building Common Area for the building in which the Unit is <br />1 <br />CCRS -One Marina. docx <br />
