F. - Page 14 <br />"Condominium Documents" shall mean and refer to this Declaration, including the exhibits <br />attached hereto, the Articles, the Bylaws, any Declaration of Annexation, the Limited Warranty and any <br />Association Rules as may be established, as any of the foregoing may be amended from time to time. <br />"Condominium Map" shall mean and refer to the recorded final map for condominium purposes <br />for Parcel 2 described in Recital B of this Declaration. Condominium Map shall also mean and refer to <br />any such document described as such in a Declaration of Annexation. <br />"Condominium Plan" shall mean and refer to the diagrammatic floor plan depicting all Units <br />located in the Development, which identifies each Unit and establishes its dimensions pursuant to Civil <br />Code Section 1351(e), as further described and shown on the Condominium Plan — Phase I, One Marina, <br />which was recorded on [ 1 1 20[1, as Instrument No. [ 1 in <br />the Official Records. Condominium Plan shall also mean and refer to any such document described as <br />such in a Declaration of Annexation. <br />"CPI" shall mean and refer to the Consumer Price Index (1982/84 =100) for all Urban Consumers <br />published by the United States Department of Labor, Bureau of Labor Statistics for the San <br />Francisco /Oakland area, or any successor entity thereto. <br />"Davis- Stirling Act" or "Act" shall mean and refer to the Davis - Stirling Common Interest <br />Development Act, codified in California Civil Code Section 1350 et seq. <br />"Declarant" shall mean and refer to the undersigned and such successors and assigns as the <br />undersigned may designate pursuant to the procedure set forth in Section 11.6. <br />"Declaration" shall mean and refer to this Declaration of Covenants, Conditions and Restrictions <br />Establishing a Plan for Condominium Ownership of One Marina, and any amendments, modifications or <br />supplements hereto. <br />"Declaration of Annexation" shall mean and refer to any instrument recorded in the Official <br />Records which extends the provisions of this Declaration to all or a portion of the Annexation Property or <br />any other property. A Declaration of Annexation may impose covenants, conditions or restrictions or <br />reserve easements for all or a portion of the Annexation Property in addition to the covenants, conditions, <br />restrictions and easements established by this Declaration. A Declaration of Annexation may modify this <br />Declaration as it applies to the real property encumbered by the Declaration of Annexation. <br />"Development" shall mean and refer to the Property in Phase 1 together with all structures and <br />improvements now or hereafter existing or erected thereon and all property, real or personal, intended for <br />or used in connection therewith. The Development shall also mean and refer to any subsequent Phase(s) <br />which become annexed into the Development in accordance with Section 2.8, and which, thereby, <br />become subject to this Declaration. <br />"Development Agreement" means, collectively, the Development Agreement between the City of <br />Redwood City and R.C. Peninsula Park, LLC as approved by City Ordinance 2323 on January 14, 2008 <br />and recorded in the Official Records of the County of San Mateo on 4/9/08 as Document Number 2008- <br />039357, and the First Amendment to Development Agreement between the City of Redwood City and <br />R.C. Peninsula Park, LLC recorded in the Official Records of the County of San Mateo on 10 /1 /10 as <br />Document Number 2010 - 115130, as may be further amended. In the event of any conflict between this <br />Declaration and the Development Agreement, the Development Agreement shall control. <br />"DRE" means the California Department of Real Estate <br />4 <br />CCRS -One Marina. docx <br />
