F. - Page 30 <br />(1) Annual notices of the Association's operating budget, Assessment and <br />Reserve Funding Disclosure Form, and the Association's foreclosure rights (See Section 4.11); <br />(2) Annual notices concerning insurance policies maintained by the <br />Association (See Section 9.9(c)); <br />10.2); <br />1363(g)); <br />of the Bylaws; <br />(3) Notices concerning alternative dispute resolution (See Sections 10.1 and <br />(4) Schedule of fines adopted by the Association (Civil Code Section <br />(5) Balance sheet and related information as set forth in Section 9.08(d)(2) <br />(6) Statement of any transaction or indemnification described in California <br />Corporations Code Section 8322(d) and (e), and a statement notifying members of their right to have <br />copies of minutes of meetings of the governing body, as set forth in Section 9.08(d)(4) of the Bylaws; <br />Code Section 1378; and <br />(7) Notice of Architectural Guidelines and Procedures required by Civil <br />(8) Other notices and disclosures required by Civil Code Section 1365, <br />1365.1, 1365.2.5, 1365.3 and 1365.5. <br />(r) Telecommunications Contract Notwithstanding anything stated in the <br />Condominium Documents to the contrary, the Board shall have the power and authority to enter into, <br />accept an assignment of, or otherwise cause the Association to comply with the terms and provisions of <br />an exclusive telecommunications services contract ( "Telecommunications Contract ") with a <br />telecommunications service provider ( "Service Provider ") pursuant to which the Service Provider shall <br />serve as the exclusive provider of telecommunications services to each Unit in the Development. The <br />Board shall only enter into, accept an assignment of, or otherwise cause the Association to comply with <br />the terms of a Telecommunications Contract if the Board determines that such action is in the best <br />interests of the Association. Among other factors the Board deems appropriate, the Board shall consider <br />the following factors in making such a determination: <br />(1) The initial term of the Telecommunications Contract should not exceed <br />five (5) years, and if the Telecommunications Contract provides for automatic extensions, the length of <br />such extension should not exceed five (5) years. <br />(2) The Telecommunications Contract should provide that (a) at least six (6) <br />months prior to the expiration of either the initial term or any extended term of the Telecommunications <br />Contract, the entire membership of the Association may, without cause by a sixty percent (60 %) vote, <br />prevent any automatic extension that the Telecommunications Contract may provide and thereby allow <br />the Telecommunications Contract to expire and (b) at any time the Board may terminate the <br />Telecommunications Contract if, in the sole discretion of the Board, the Service Provider fails to provide <br />quality, state of the art telecommunications services. <br />(3) Whether the monthly or other fees charged to the Association by the <br />Service Provider for the provision of the telecommunications services to all of the Units represents a <br />20 <br />CCRS -One Marina. docx <br />
