B. - Page 1 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />September 19, 2011 <br />SUBJECT <br />Summary Vacation of Public Right -of -Way — Valota Road <br />RECOMMENDATION <br />Adopt a Resolution, summarily vacating a portion of Valota Road. <br />BACKGROUND <br />Valota Road, originally named Arlington Avenue in 1910, was realigned with subdivision <br />developments in the early 1970s. The realignment eliminated an awkward mid -block <br />intersection and created a curve in Valota Street, improving roadway travel between <br />Silver Avenue and Redwood Avenue. <br />ANALYSIS <br />As a result of the re- alignment, a remaining triangular shaped area was left over from the <br />Arlington right -of -way that has been unused for public purposes. City Engineering and <br />Public Works Services staff have determined that this portion of right -of -way is <br />unnecessary for public purposes and public funds have not been spent on this area <br />within the past five years. For this reason the city may seek a summary vacation rather <br />than a general vacation of this property. <br />The developer of the adjacent parcel, 1410 Valota, has requested that the City vacate <br />this unused portion of right -of -way pursuant to the Street Vacation Act, California <br />Streets and Highway Code, Section 8330. The City upon adoption of the proposed <br />resolution, would relinquish its rights to use 1,060 square feet of land at the subject <br />location, and a title company would then determine proper disposition of the <br />relinquished area which may or may not revert to the owner of the 1410 Valota parcel. <br />If the vacated parcel is added to 1410 Valota, the frontage of the proposed subdivision <br />at 1410 Valota may be made more attractive, and properly maintained, which will be a <br />benefit to the community. There is an existing hydrant within this area that may be <br />moved within the future development. <br />The original right -of -way was granted by dedication; therefore the city does not have fee <br />ownership of the area proposed for abandonment. For this reason the city's interest in <br />this property may be relinquished but cannot be sold. <br />
