The Colrr�a Municipal Code is hereby amended by adding #hereto the following suhsections; Sec��on 5,41.0�0 �3e��aations. (a) "Medical Marijuana Dispensary" or"Dispensary"means any facili�.y or�ocation, whether fixed or mobife, where medical marij�ana is made available tv or distributed by or dis�ributed ta one (1) or more of the follawing: a primary caregiver, a auali�ied p�tie�t, or a patien�wit� an identi�catior� card. All three of these terms are identified in stric� accordance with California Health and Safety Cade 5et�ion 13.362.5 et s�q. A "medical marijuana dispe�sary"shali not include�he fdllowing uses, as lang as the �� focatior� of such uses is atherwise regulated by this Code ar applicabie law: a clinic li�ensed pursuant to Chapter 1 of Division 2 of the Health and 5afety Cade; a hea[thcare fa�ility licenser! pursuant to Chapter 2.of DivESian 2 of the �lealth and Safety Code; a facility licer�sed pursuant to Chapter 2 of Division � of the.Heafth and 5afety Code; a residenrial care faciiity fior persans with chronic life threatening illness licensed pursuant to Chapter 3.01 af Divisian 2 of the Healfih and Safety Cade; a residential care fac€€ity for ' elderly licensed pursuant to Chapter 3,2 nf Divisian 2.of fihe Health and 5afety Code; a resident�al hospic�, ar a home t�ealth agency licensed pursuant to Cf�apter 8 afi Division 2 af the Health &Safery Code, as lang as such use complies strictly with applicable law, ineluding but not Eimited to, Health &Safety Code Sec�ion 11362.� etseq, ' Secti�n Medic�l Marijuana Disperrsary as a �ro�ibited Use.
