MYSCELLANEOUS PROVISIONS <br /> 7.46.090 ENFORCEMENT OF CHAPT�R. The Police Chief ar the Chief's <br /> designee may investigate and enforce any violaCions oF this chapter, and to repart <br /> and enforce against any violations af the conditions oP approval attacE�ed to <br /> [icenses required by and abtained pursuant Eo this Chap�er. The Chief may report <br /> violations of �hese provisions to the License Committee, for possible re�ocatian of <br /> tY�e license obtained under �his Chapter. Any violation of this chapter <br /> shal! be deemed a misdemeanor, unless �he circumstances that create the <br /> violation are subject to prosecution under s�ate or federal [aw. Any viola�ion of <br /> this chapter shall also be deemed a public nuisar�c� and may be enforced by any <br /> remedy available to the Cjty for abatement of public nuisances. (Ord. 2009-6 § <br /> 1, 2009). <br /> 7.46.110 MARIJUANA PRODUC�D ��R YNDIVIDUAL RESTDENTIAL ON- <br /> SITE CONSUMPTION. <br /> {a) Nothing in this chapter sf�all be deemed to make unlawful an individual's <br /> cultivation of m�dical marijuana at their awn residence for their own use, or �ar <br /> the use by another person regularly residing at such residence� if such cultivation, <br /> �QS52S51011 or use is lawful under Heafth and Safery Code sections ],J.362.7 <br /> through �136Z.77. <br /> (b) Marijuana cultivated and possessed at a privar� residence r�tust no� be <br /> visible from adjacent pu�lic areas or neighboring properties, and must be secured <br /> within structures consisting of at leas� four walls and a roof with standard locks. <br /> (Ord. 2009-6 § 1, 2009). <br /> 7.46.12Q SEV�RABILTTY. If a�y section, subsection, sentence, clause, or <br /> phrase of this Chapter, is for any reason held to be in�alid, unlawful, or <br /> unconsritutional, such invalidity or unconstitutionality shall not affect the validity, <br /> lawfulness, or constitutionality of any or all other portions of fhis Chapter.
