7.A. - Page 67 <br /> ATTACHN�NT 3 <br /> Mrs. Stevenson stated that the moratorium will expire and cannot be extended so if the <br /> recommendation is to adopt the proposed zoning amendment including the sunset <br /> clause as opposed to continuing the ban, that should be clarified. <br /> Commissioner Radcliffe replied yes, she does not want to see the subject dropped and <br /> she is in favor of the ban with the sunset clause. She stated that court cases are <br /> pending and there are questions that are not answered yet. <br /> Commissioner Schmidt agreed with Commissioner Radcliffe and stated that he would <br /> also like it to have a clear message that the council is not saying they are banning this, <br /> there just needs to be more information. <br /> M/S (Radcliffe/Schmidt) to put in place a ban and include a sunset clause. <br /> Commissioner Bondonno spoke to the motion, and for clarity stated that the motion is to <br /> accept staff's recommendation for a ban on such facilities and to include a sunset clause <br /> to revisit the issue by two years after the decision by city council. <br /> Chair Borgens stated the alternative says the city council should consider the zoning <br /> amendment to establish a ban on medical marijuana distribution facilities. The draft <br /> ordinance contains an option for a sunset clause to provide for another assessment of <br /> this issue at a future set time such as in two years. <br /> Commissioner Bondonno stated that the only option from staff's original <br /> recommendation is the sunset clause. <br /> Commissioner Radcliffe replied yes. <br /> Chair Borgens asked Ms. Skousen if that is good. <br /> Ms. Skousen replied yes. <br /> Motion Passed: 5-0, all yes <br /> Chair Borgens thanked the speakers for bringing their knowledge and experience to the <br /> commission. <br /> 6. MATTERS OF COMMISSION INTEREST: <br /> Mrs. Ekas noted the next meeting, September 27th, to discuss the 33 Main Street <br /> Project. Staff would bring initial study mitigating negative declaration and a tentative <br /> map. Forthcoming zoning activities: next step in getting the general plan zoning in <br /> place, with mixed use neighborhood, including distinct nodes on Woodside Road as well <br /> as the two ends to EI Camino Real, the mixed use live-work category, and talk about the <br /> SB 2 Transitional Housing emergency shelter overlay area, a requirement by state law. <br /> Also be looking at the commercial office park technology category, with a higher floor <br /> area to ceiling ratio, with some ideas about how to get incentives into that area to allow <br /> high quality infill development of office parks to maintain public open space, incubator <br /> overlay, small startup business needs.
