7.A. - Page 1 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />October 24, 2011 <br />SUBJECT <br />Report Regarding Massage Service Regulation <br />RECOMMENDATION <br />Receive Report Regarding Massage Services Regulation and Provide Direction on <br />Proposed Regulations. <br />BACKGROUND <br />The City needs to update its Municipal Code to comply with state law regarding <br />regulation of massage services. In addition, there have been complaints in the <br />community about the number of massage establishments that have recently been <br />permitted or are pending, particularly along El Camino Real and Woodside Road. This <br />report addresses the City's limited authority to regulate massage establishments and <br />the limited options for regulating their growth. <br />State Preemption of Local Authority to Regulate State - Certified Massage Workers & <br />Establishments <br />Typically, cities would establish regulations under their police powers to control or <br />require the following: <br />• Massage worker permit <br />• Massage business or establishment permit <br />• Background checks and fingerprinting <br />• Educational requirements <br />• Medical Exam <br />• Annual renewal <br />• Operational requirements (separate bathrooms, clean towels, no locked doors, <br />etc.) <br />Chapter 18A, established in 1972, provides for a review of an applicant's eligibility for a <br />City permit through a three step review process wherein an applicant must obtain: (1) a <br />zoning verification letter to confirm that the zoning allows the use; (2) the qualifications <br />of the practitioners and operators are verified either through state clearance or Police <br />Department background check on practitioners and owner /operators; and (3) a use <br />permit.
