6.2.B. - Page 2 <br />The original right -of -way was granted by right -of -way easement dedication, therefore the <br />City does not have fee ownership of the area proposed for abandonment. For this <br />reason the City's interest in this property may be relinquished but cannot be sold. <br />The Street Vacation Act of 1941 authorizes the vacation of all or part of any city street, <br />by an order of City Council. The general vacation, once complete, will relinquish the <br />City's interest in the right -of -way and the right -of -way area will revert to the adjacent <br />owner, who appears to be Kaiser Permanente. The right- of -way proposed for vacation <br />is more particularly described in a legal description and plat map attached to this report <br />as exhibits to the proposed resolution. <br />Should this resolution of intent to vacate be approved by the City Council, next steps <br />are as follow pursuant to the California Streets & Highway Code, Section 8320. <br />1. Publish notices in the newspaper for two successive weeks prior to the hearing; <br />2. Post the property lines with at least three notices in conspicuous places not more <br />than 300 feet apart; and <br />3. Hold the public hearing and receive evidence on November 14, 2011 from all <br />persons interested in the matter and determine from the evidence whether or not the <br />street is unnecessary for present or prospective public use. <br />In addition, the City will send notices to property owners within 300 feet and also notify <br />affected utilities. <br />ALTERNATIVES <br />Council may choose not to adopt a Resolution of Intent to vacate a portion of Walnut <br />Street which would be contrary to the intent of the parties. <br />FISCAL IMPACT <br />This action will not impose any new financial responsibility to the City at this time. <br />ENVIRONMENTAL REVIEW <br />As the lead agency, City of Redwood City has determined that the actions proposed in <br />this reports do not constitute a project as defined by the California Environmental <br />Quality Act. <br />C <br />PAUL WILLIS, PE <br />SENIOR CIVIL ENGINEER <br />
