6.2.E. - Page 1 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />October 24, 2011 <br />SUBJECT <br />Guidelines for the Submission and Tabulation of Protests in Connection With Rate <br />Hearings Conducted Pursuant to Proposition 218 <br />RECOMMENDATION <br />Approve a Resolution of the City Council of the City of Redwood City Adopting <br />Guidelines for the Submission and Tabulation of Protests in Connection With Rate <br />Hearings Conducted Pursuant to Proposition 218. <br />BACKGROUND <br />Article XIIID, Section 6 of the California Constitution, which was adopted by the voters in <br />1996 as part of Proposition 218, requires that local governments give a special form of <br />mailed notice at least 45 days before holding a public hearing on the increase of a <br />property - related fee. The provision also provides that certain affected persons may <br />submit protests with respect to proposed rate increases. <br />The requirements of the applicable notice and protest provisions are relatively brief, and <br />do not make it absolutely clear how, for example, local agencies should count protests <br />they receive. Consequently it is recommended that the City adopt guidelines to govern <br />how the City will conduct protest proceedings. These guidelines are consistent with <br />those adopted by other California Cities. <br />ALTERNATIVES <br />1. Do not adopt a written policy and allow staff to interpret questions on a case by <br />case basis. <br />2. Make other changes to the policy. <br />FISCAL IMPACT <br />There is no fiscal impact associated with the adoption of this policy directing staff to <br />follow guidelines for the submission and tabulation of protests. <br />ENVIRONMENTAL REVIEW <br />N/A <br />
