6A.A. - Page 3 <br />enforcement program coordinated with the Planning Division review process thus far <br />have effectively regulated massage services within the Redwood City's jurisdiction, but <br />the Police Department expresses a somewhat increased concern with the <br />workers /establishments that are not state - certified. <br />After reviewing the options for regulating massage establishments, the City Council <br />decided it preferred allowing only state - certified massage workers and businesses that <br />employ only state - certified workers because this would create consistent rules and <br />regulations; provide a stream -lined review process; require meeting high educational <br />standards; and achieve compliance with state law. The City Council directed staff to <br />proceed with the draft ordinance it had been presented with some revisions such as <br />deleting a prohibition against outcall massages. <br />The ordinance attached hereto and presented for introduction contains these key <br />elements: <br />• Requires all massage practitioners to become state - certified and all massage <br />establishments to employ only state - certified massage practitioners; <br />• Requires background check for business owners that own 5% or more of a <br />massage business and are not state - certified; <br />• Establishes effective date of July 1, 2012 to provide time for businesses and <br />workers to comply with the new regulations — however, some cities are providing <br />as much as a year; <br />• Requires massage businesses and practitioners to register with the city to verify <br />possession of valid and current state - certifications and require zoning clearance <br />letter and business license; <br />• Sets renewal at every two years; <br />• Exempts certain classes of persons and businesses as required by state law <br />such as physicians, nurses, physical therapists, chiropractors, barbers, hospitals, <br />and health clubs from requirement to obtain massage business Certificate of <br />Registration; <br />• Establishes health and safety requirements such as clean linens, sanitized <br />equipment, and no closed shades or curtains on front windows and doors during <br />business hours; and <br />Provides right to enter during business hours to conduct reasonable inspections to <br />enforce compliance with building, health, and other related codes. <br />FISCAL IMPACT <br />None <br />ALTERNATIVES <br />1.
