i. Amendment ro Cazds and/or Services. Bank and/or EPX may amend or dclete Cards or Services <br /> listed in Schedule A by notifying Merchnnt in wri[ing of any amendmen[ with a minimum of <br /> thirty (30) days prior written notice if reasonably practicable. All provisions of this Agreement <br /> shall apply to Cazds or Services addeA to this Agreement. Bank or EPX shall notify Merchant of <br /> the fees to be charged for processing the additional Cards and Services. Acceptance by Merchant <br /> of a new approved Card as payment for a Transaction or use of a new Service after Bank or EPX <br /> has sent Merchant noucc of an amendment shall wnstitute Merchan4s agreement to the <br /> amendment and the fees or chazges related to these additions. <br /> ii. Amendment ro Fees and Charees. From Ume to fvne, Bank and/or EPX may change all non-pass <br /> through rates, fees and chazges set forth in Schedule B. Bank or EPX will provide written notice <br /> to Merchant of all amendments with a minimum of thircy (30) days prior written notice if <br /> reasonably practicable. Notice may be given on the Merchant Statement. All non-pass through <br /> rates, fees and charges will become effective for the month immediately following thc month in <br /> which the notice appeazed ou the Merchant Statement unless Merchant terminates this Agreement <br /> in acwrdance with Pazagraph 6.4 ("Tecmination of Agreement by MerchanC'). <br /> iii. Volume Adiustments. Bank or EPX may change the rates, fees and charges without prior written <br /> notice if MerchanYs sales volume or averagc Transacdon amount does not mect Merchant's <br /> projections contained in Merchant's application for card proccssing services inivally submitted to <br /> and approved by Bank and EPX. <br /> 10.16. Notices. Except for notices provided by Bank to Merehant on the Mcrohant Statement, all notices, <br /> requests, demands or othcr instrumeuts which may or are required to be given by any party herein shall <br /> be in writing and cach shall bc deemed to have been properly given <br /> i. When served personally on an officer of the party to whom such notice is to be given; <br /> ri. Upon expiration of a period of three (3) Business Days Gom and after the date of mailing thereof <br /> when mailed postage prepaid by registered or certified mail, requcsting retum receipt; or <br /> iii.
