" STORAAWATER TREATINENT MEASURES <br /> MAINTENANCE AGREEMEPIT <br /> 602 EI Camino Real <br /> Redwood City, CA 94063 <br /> RECITALS <br /> This Stormwater Treatment Measures Maintenance Agreement (°AgreemenY') is entered <br /> into this July 1, 2011, by and belween the City of Redwood City ("Cityr') and [insert name of <br /> property owner] (°PropeRy Owne�°), a property owner of real property described in this <br /> Agreeme�. <br /> A. On February 19, 2003, the R�ionai Water Quality Control Board, San Francisco <br /> Bay Region, adopted Order R2-2003-0023, amending the San Mateo Countywide NPDES <br /> Municipal Stormwater Pertnk (Qrder 99-059, CAS0029921) ("NPDES PermiY); and <br /> B. Provision C.3e.ii. of the NPDES Permi� and as d may be amended or reissued, <br /> requires the permittee public agenaes to provide minimum verification and access assurancES that <br /> all treatment measures shall be adequately operated and maintained by er�tities responslble for the <br /> stortnwrater treatrnerrt measures; and <br /> C. The Property Owner Is Arton Investment �nc, is the owner of real property <br /> commonly k�own as 602 El Camino Real (the °Property°), and more particularly described in <br /> Exhibit °A', and incorporated herein by this reterenoe. <br /> D. Attached hereto as Exhibit "B", and incorporafed herein by this reference, is a <br /> legible reduc�d-scafe copy of the Sfte Pfan or comparable document showing the stormwatar <br /> treatment measures that are.to be located or to be constructed on the Property, hereina�ter <br /> referred to as the `Sfte Plan°; and <br /> E. Attached hereto as Exhibit °C° and incorporated herein by this reference, is an <br /> "Inspection and Malntenancs Checklist° which describes the homeowner's maintenance <br /> activities to be performed pursuant to ihis agreement. <br /> F. The City is the permittee public agency with jurisdiction over the Property. <br /> G. The Property Owner recognizes that the storrnwater treatmem measura(s) more <br /> particufarfy described and showm on Sfte Plan, of which full-scale plans and any ame�dments <br /> thereto are on file with the Engineerirg & Consduction Services of Ehe Ciry of Redurood City must be <br /> inetalled and maintained as indicated in this Agreement and as required by the NPDES Permit. <br /> H. The City and Property Owmer agree that the health, safety and welfare of the <br /> dtizens of ihe Ciiy require that Uie stormwater treatmerrt measure(s) detailed in the Site Plan or <br /> c:omparable docx�ment be �nstructed and maintained on the Property; and <br /> 1.
