Attach 6.2. - Page 22 <br />ORDINANCE NO. <br />ORDINANCE OF THE CITY OF REDWOOD CITY AMENDING <br />SECTION 32.75 OF THE REDWOOD CITY MUNICIPAL CODE TO <br />INCREASE THE TRANSIENT OCCUPANCY TAX ON RENT CHARGED <br />TO HOTEL GUESTS FROM TEN PERCENT (10 %) TO TWELVE <br />PERCENT (12 %) <br />The People of the City of Redwood City Ordain as follows: <br />Section 1. Section 32.75 of the Redwood City Municipal Code is hereby <br />amended to reads as follows: <br />SECTION 32.75. IMPOSITION; AMOUNT; WHERE PAYABLE <br />For the privilege of occupancy in any hotel, each transient is subject to and shall <br />pay a tax in the amount of twelve percent (12 %) of the rent charged by the <br />operator. Said tax constitutes a debt owed by the transient to the City which is <br />extinguished only by payment to the operator or to the City. The transient shall <br />pay the tax to the operator of the hotel at the time the rent is paid. If the rent is <br />paid in installments, a proportionate share of the tax shall be paid with each <br />installment. The unpaid tax shall be due upon the transient's ceasing to occupy <br />space in the hotel. If for any reason the tax due is not paid to the operator of the <br />hotel, the tax administrator may require that such tax shall be paid directly to the <br />tax administrator. <br />Section 2. Approval General Municipal Election; Effective Date. <br />This ordinance amending Section 32.75 of Chapter 32 of the Redwood City <br />Municipal Code shall be in full force and effect ten (10) days after the date on which the <br />City Council has approved the canvass of votes and declared that the voters of the City <br />of Redwood City have approved said ordinance by a vote of no less than a majority of <br />the votes cast by the electors voting on the tax measure set forth in this ordinance at the <br />general municipal election to be held on Tuesday, November 8, 2011. The effective <br />date for purposes of levying the increased tax shall be January 1, 2012. <br />Section 3.
