<br /> engineering e�•rors, errors or adjustments i� o��i�;inal constr�.iction, reconstruction, repair,
<br /> settlement, shifting, o�� any other cause, the Owne�• af the enc�•oachment shall have the right to
<br /> znaix�tain, repair, or replace the encroac�rnent, as long as it �xists, and the rights and obligations
<br /> of Owtters shall not be alteied in any way by said enc�•oach�nent, set��err►ent, o�• shifting;
<br /> provided, hawevet•, that na t•igl�t sl�all be cr�ated in favar of an Owner or Owners if said
<br /> ei�croachmet�t occu�•red d�� to the intentior�al conduct af said Owner or Owners othec than
<br /> adjust�nents by Declaz�ant in the original construction. In the event a st�•ucture is partially o�•
<br /> totally destroyed, and then repaired or rebuilt, tl�e Owne�•s agree tl�at �ninor encroachments over
<br /> Commoi� Area shall be pe�mitted and tl�at there shall be appropriate rights for the maintena�ce of
<br /> said encraachments so long as they shall exist. In the e�ent that an e�•rar i� engineering, design,
<br /> oi• constc�iction results in an encroach�nent af a b€�ilding into the Cominan Area, o�• inta a
<br /> �•eq�.�ired setbacic area, a co�•z�ecti��g �noditication rnay be inade in the Map �nd/or the subdivisian
<br /> pIa�. Said madification shall be in the form of a cerlifiea�e of correctian and s�all be exeeuted
<br /> by Declarant (so long as Declarant is th� sole o�v�er of t�ie Property), in additio��, by the City
<br /> engineer (in the case of tihe Map).
<br /> 6.b Ri�htis of Lenders: Na breach of arty of the covenants, canditions, and r�strictions
<br /> herein contained, nar tl�e enforcernent of any provisions hereof, shalI render invalid the lien of
<br /> any martgage on any Lot made in good fai�h and for value, b�t all of said covenants, conditions,
<br /> and restrictions shall be binding �tpon and ef,fective against any Owner whase title is derived
<br /> tht•oug�i foreclosure oz� trustee's sale, or otherwise.
<br /> 6.7 Insura�lce; Damage ot• Destruction:
<br /> A. Association's Insurance: The Assacia�ion shall obtain and maintai�� the
<br /> following i►�s�trance:
<br /> (1) commercial general liability inst�tanee cove�•ing the Cominon A��ea
<br /> in a�� amount �►ot less than Two Mill�o�� Dollars ($2,000,000) on an occu�•x•ence basis, if available,
<br /> ins��ring the Associa�ion, the Board of Directors, the agents of the Association and tl�e Owners
<br /> against liability ineident to the ownership or i�se of the Common Area; the amount of general
<br /> liability insu�•ance which the Association shall car�•y shall not be less ti�an the rninimum amounts
<br /> required by Califarnia Civil Code Sections t365.7 and I365.9.
<br /> (2) A policy of hazard i�sut•ance covering all of the imp�•over�ents of
<br /> the Common Areas af the Pi�oject and all fixtures and bttilding service equipment therein, which
<br /> palicy of hazard insurance shall provide for "multi-peril" or "all-risk" coverage, includia�g, as
<br /> minitnu�n protection, p�•otect�on fi•oi�n loss ar dainage by fiz�e or ather hazards caverec� by the
<br /> standard extended coverage endo�sement, and by dcbris rejnoval, cast of demolition, vandalism,
<br /> �nalicious rrfischief, wind storm, water damage and other rislcs as ara ct►sto�nacily cove�ed with
<br /> respect to prajects simila�• in canstructio�i, location and use to the Project. Sucl� policy shall
<br /> include an "ag�•eed amou��t endorseinent" or "inflation g�ard enc�orseinent", o�� an equivalent
<br /> thereof, a"d�nr�olitian endarsement", or equivalent thereaf, and, if such is commercially
<br /> t'easonable ta obtain, an "inc��eased cost of construction endorseine��t" and a"contii�gent liability
