6.4.A. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> December 12, 2011 <br /> SUBJECT <br /> Two Ordinances Amending Municipal Code Appeal Procedures and Provisions <br /> RECOMMENDATION <br /> Waive First Reading and Introduce an Ordinance Adding a New Article III to Chapter 1 <br /> Establishing General Appeal Procedures and Provisions <br /> Waive First Reading and Introduce an Ordinance Amending Miscellaneous Provisions <br /> of the Redwood City Municipal Code Relating to Appeals <br /> BACKGROUND <br /> The appeal and notice provisions in the Municipal Code and in the Zoning Code need to <br /> be updated in order to stream line the appeals process, to achieve consistency with <br /> state law, and to establish consistency and uniformity with other appeal provisions in the <br /> Code. This report addresses recommended changes to the Municipal Code. A second <br /> report will follow in the near future addressing recommended changes to the Zoning <br /> Code. <br /> There are two proposed ordinances presented as part of this report. The Council <br /> subcommittee on appeals (Council Members Pierce and Bain) has reviewed and <br /> recommends adoption of the two ordinances. The first ordinance adds new Article III to <br /> Chapter 1 to create a general appeal provision for all appeals. During the October 10 <br /> 2011 City Council meeting, Council considered a draft of this proposed ordinance and <br /> directed that staff return the ordinance for first reading subject to some modifications, <br /> including ensuring that the City Council had the opportunity to hear all significant land <br /> use matters. The proposed ordinance is Attachment 1. <br /> The main provisions of the proposed amendment to Chapter 1 of the Municipal Code <br /> are as follows: <br /> 1. Establishes a new Article III which contains procedures for all appeals absent a <br /> different regulation specified elsewhere in the Code to address a unique <br /> circumstance. <br /> 2. Allows the City Council to request review of any final determination of the highest <br /> authority on a matter after exhaustion of all appeal rights by submitting a written <br /> request to the City Clerk within 15 days of a decision being final.
