6.4.A. - Page 4 ATTACHMENT 1 <br /> ORDINANCE NO. <br /> ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> REDWOOD CITY ADDING A NEW ARTICLE III TO CHAPTER 1 <br /> OF THE REDWOOD CITY CODE RELATING TO APPEALS <br /> WHEREAS, the purpose of this ordinance is to add uniform procedures for <br /> appeal hearings within the city of Redwood City. <br /> NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD CITY <br /> DOES ORDAIN AS FOLLOWS: <br /> Section 1. A new CHAPTER 1 ARTICLE III is hereby added to the <br /> Redwood City Municipal Code to read as follows: <br /> ARTICLE III PROCEDURES ON APPEALS <br /> Sec. 1.46 GENERAL APPEALS PROCEDURES <br /> All appeals, for which there is no conflicting specific provision in this Municipal <br /> Code or in the Redwood City Zoning Code, shall be processed and heard as set <br /> forth in this Article III. <br /> Sec. 1.47 TIME FOR APPEAL <br /> Notwithstanding contrary or conflicting provisions in other sections of this <br /> Municipal Code or the Redwood City Zoning Code, any authorized appeal must <br /> be filed within fifteen days of the date of the notice of decision being appealed. <br /> Sec. 1.48 FORM OF APPEAL <br /> A. All appeals authorized by this Municipal Code or the Redwood City <br /> Zoning Code shall be filed with the City Clerk and must be in writing on <br /> forms provided by the City. The Appellant must submit, together with <br /> the appeal form, any documents, records and/or written materials <br /> requested to be considered by the Reviewing body. <br /> B. Any two Councilmembers may request City Council review of any final <br /> determination of the Planning Commission, City Manager, Zoning <br /> Administrator, Community Development Director or other discretionary <br /> decision by City staff by filing a written request with the City Clerk <br /> within fifteen days of the date of the Notice of Final Decision. No <br /> appeal fee shall be required for such councilmember request. Upon <br /> receiving a request for such review from two City Councilmembers, the <br /> City Clerk shall place the item on the next available City Council <br /> agenda, as determined by the City Manager.
