6.5.A. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> December 12, 2011 <br /> SUBJECT <br /> New Ordinance Regulating Massage Services <br /> RECOMMENDATION <br /> Waive Second Reading and Adopt an Ordinance Repealing Existing Chapter 18A and <br /> Enacting New Chapter 18A Regulating Massage Services <br /> BACKGROUND <br /> During its meeting on October 24, 2011, the City Council received a report regarding the <br /> current law on regulating massage services. In order to comply with state law and <br /> create a stream-lined review process, the City Council decided to allow only state- <br /> certified massage workers and businesses to perform massage services in Redwood <br /> City. The Council directed that an ordinance be drafted in accordance with its direction. <br /> During its meeting on November 14, 2011, the City Council waived the first reading and <br /> introduced an ordinance regulating massage services. In compliance with Cal. Gov't <br /> Code § 36934 and subject to minor revisions to ensure internal consistency with word <br /> usage, numbering, and correcting non-substantive errors, the ordinance is being <br /> presented at this meeting for second reading and introduction. <br /> The ordinance attached hereto and presented for introduction contains these key <br /> elements: <br /> • Requires all massage practitioners to become state-certified and all massage <br /> establishments to employ only state-certified massage practitioners; <br /> • Requires background check for business owners that own 5% or more of a <br /> massage business and are not state-certified; <br /> • Establishes effective date of July 1, 2012, to provide time for businesses and <br /> workers to comply with the new regulations; <br /> • Requires massage businesses and practitioners to register with the city to verify <br /> possession of valid and current state-certifications, zoning consistency check, <br /> and business license; <br /> • Sets renewal at every two years; <br /> • Exempts certain classes of persons and businesses as required by state law; <br /> • Establishes health and safety requirements such as clean linens, sanitized <br /> equipment, and no closed shades or curtains on front windows and doors during <br /> business hours; and <br /> • Provides right to enter during business hours to conduct reasonable inspections <br /> to enforce compliance with building, health, safety, and other related codes. <br />
