C. - Page 22 <br /> AT7ACHMENTa <br /> c} Own�r shall allbw reasonable periodic examFnations, by prior <br /> appointment, of the interior and exterior af the Historic Property by <br /> representati�es of the County Assessor for the County of San Mateo, the <br /> California Department af Parks and Recreation, the Cafiforr�ia Board of <br /> Equalization, the Historic Resources Advisory Committee and City, as may be <br /> necessary to determine owner's compliance with the terms and provisions of this <br /> Cantract, but in any e�ent, #here shall be af feast one inspection annually by one <br /> or more representatives of the City and the Historic Res�urces Advisory <br /> Committee. <br /> d} Owner or agent of Owner shall provide writt�n notice of the cantract <br /> #o the Otfice of Historic Preservation within six {6) months of entering into this <br /> Cantract. <br /> 5. Provision of �2e t�es�ed Information. Owner hereby agrees to furnish City <br /> with any and all information requested by the City which may be necessary or advisable <br /> t� determine compliance wi�h the terms and provisions of this Contract. <br /> 6. Can�ellation for Breach. City, following a duly noticed public hearing <br /> pursuant to California Goverrtment Code Sections 50280, et. seq., may cance! this <br /> Contract if it determines that Owner breached any of the conditi�ns af this Contract or <br /> has aflow�d the proper�y to deteriorate to the point that it no longer meets the standards <br /> for a qualified historic praperty. City may alsa cancel this Contract i# it determines that <br /> the Owner has failed ta restore or rehabilitate the property in the manner specifie� in <br /> subparagraph 4(b) of this Contract. In the event of cancellation, Owner may be subject <br /> to payment af those cancellafian fees set forth in Califarnia Government Code Sectians <br /> 50284, et. seq. <br /> 7. Enforeement of Contract. As an alternati�e to cancellafion of the Contract <br /> far breach of any condition, City may specifically enforce, or enjoin the breach af, the <br /> terms af this Contract. In the event of a def�ult under the provisions of this Contract by <br /> 4wner, Gity shall gi�e w�itten notice to Owner by registered or certifted ma�l addr�ssed <br /> to the address stated +n this Contract, and if such a violatian is nat corrected to the <br /> reasonable satisfactio� of the City within thirty (30) days thereafter, or if not corrected <br /> within such reasonable time as may be r�quired to cure the �reach or default if said <br /> breach of default cannot be cured within fhirty {30) days (provided that acts to cure the <br /> breach or default must be commenced within thirty (3Q) �ays and must thereafter be <br /> diligently pursued to compietion by Owner}, then City rnay, w�thout further notice, <br /> declare a default under �he terms of this Co�tract and may bring any action necessary <br /> to specifically �nfarce the obligations of Owner growing out af the terms of this Contract, <br /> appfy to any court, state or f�deral, for injuncti�e r�lief against any viofation by Owner ar <br /> apply for such other relief as may be appropriate. <br /> City does nat waive any claim of default by Owner if City does not enforce or <br /> cancels this Cantract.
