Paragraph 11 of this Agreement, on or before December 31, 2013. The Improvements <br /> shall include, but are not necessarily limited to, all of the following: <br /> (a) grading, paving <br /> (b) curbs, gutters, concrete walkways, driveways <br /> (c) sanitary sewer system, complete <br /> (d) permeable pavers <br /> (e) water system, complete <br /> (� storm drainage system, complete <br /> (g) site lighting system, complete <br /> (h) street trees <br /> (i) landscaping and irrigation system complete <br /> (j) utilityjointtrenching <br /> (k) all conditions of approval for Tentative Subdivision Map T.M. No. 2009- <br /> 02, heretofore issued for said subdivision, <br /> and all other work, improvements, or construction required by or mentioned in the <br /> abovementioned plans and specifications, conditions of permits and all construction, <br /> appurtenances and improvements necessary as reasonable determined by the City <br /> Engineer to complete the aforementioned improvements, both within and outside of the <br /> abovementioned subdivision. <br /> 2. IMPROVEMENT SECURITY <br /> A. Prior to the City's execution of this Agreement, Owner shall provide as security <br /> to the City: <br /> (1) For Pertormance: Security in an amount equal to one hundred percent <br /> (100%) of the Estimated Total cost of the Improvements, Grading and Monumentation <br /> as required herein. With this security, the form of which shall be subject to City's prior <br /> approval, the Owner assures faithful performance under this agreement. The amount of <br /> said security shall be Four Hundred Thirty Eight Thousand One Hundred Sixty and <br /> No/100 Dollars ($438,160.00). <br /> (2) For Pavment: Security in an amount equal to one hundred percent <br /> (100%) of the Estimated Total Cost of the Improvements as required herein. With this <br /> security, the form of which shall be subject to the City's prior approval, the Owner <br /> guarantees payment to the contractors, subcontractors, and persons renting equipment <br /> or furnishing labor or materials to them or to the Owner. If monumentation is involved, <br /> this improvement security shall also guarantee to the Owner's engineer or surveyor <br /> payment of the Estimated Total Cost of setting monuments, as required by Government <br /> Code Section 66597.
