deductibles or self-insured retentions with respect to City, its Council, commissions, <br /> boards, committees, officers, employees and agents or Owner shall procure a bond <br /> guaranteeing payment of losses and related investigations, claim administration and <br /> defense expenses. <br /> Concurrently with the execution of this Agreement, Owner shall furnish City with <br /> certificates and copies of information or declaration pages of the insurance required <br /> hereunder and, with respect to evidence of commercial general liability and <br /> automobile liability insurance coverage, original endorsements: <br /> a) Precluding cancellation or reduction in coverage before the expiration <br /> of thirty (30) days after City shall have received written notification of <br /> cancellation or reduction in coverage by first class mail, postage <br /> prepaid; <br /> b) Providing that Owner's insurance shall apply separately to each <br /> insured against whom claim is made or suit is brought, except with <br /> respect to the limits of the insurer's liability (cross liability <br /> endorsements); <br /> c) Naming City, its Council, commissions, boards, committees, officers, <br /> employees and agents as additional insureds; and <br /> d) Providing that Owner's insurance shall be primary insurance relating to <br /> Contractor's work hereunder with respect to City, its Council, <br /> commissions, boards, committees, officers, employees and Agents, <br /> and further providing that any insurance or self-insurance maintained <br /> by City for itseff, its Council, commissions, boards, committees, <br /> officers, employees and agents shall not be excess of Contractor's <br /> insurance and shall not be contributory with it. <br /> e) Such insurance shall also specifically insure any contractual liability <br /> assumed by Owner under the terms of this Agreement, including, but not <br /> limited to, the provisions of Paragraph 1 above. <br /> 6. MONUMENTS. All pipes and monuments shown on the subdivision map <br /> hereinafter referenced which are destroyed or displaced during construction operations <br /> shall be replaced by Owner at the time of the final inspection of the Improvements, if <br /> any, hereunder by City. <br /> 7. OWNERSHIP AND MAINTENANCE OF IMPROVEMENTS. It is agreed <br /> that title and ownership of the improved public street, sidewalk, sanitary sewer lateral in <br /> city right-of-way, and the water mains and services to the water meters, constructed for <br /> the benefit of City hereunder by Owner shall vest absolutely in City upon completion <br /> and acceptance of such Improvements by City. <br /> The Homeowners' Association will own and maintain the onsite utilities, storm <br /> drain facilities and pipes to the nearest public storm drainage system, the sewer system <br /> to the nearest public sanitary sewer system, onsite landscaping, the Common Areas, <br /> and in the areas between the back of sidewalk and the right-of-way line.
