Waivers of Develooment Standards <br /> In accordance with Section 65915(e), OWNER has proposed the waiver of, and <br /> the City has agreed to waive, the following development standards that would otherwise <br /> apply to the Project under the North Main Street Specific Plan and other City Iand use and <br /> zoning regulations. OWNER hereby acknowledges and agrees that the City's waiver of <br /> the following development standards fully satisfies the City's obligations to waive <br /> development standards under the Density Bonus Law. <br /> (a) Garaae Heiaht More than 10' Above Adiacent Grade Elevation: <br /> OWNER has requested a waiver of, and City has agreed to waive, the applicable height <br /> restriction to allow for the garage deck height above adjacent grade to be slightiy more <br /> than 10 feet, as set forth in OWNER's AHP. <br /> (b) First Fioor Heiaht More than 5' Above Adiacent Sidewalk Elevation: <br /> OWNER has requested a waiver of, and City has agreed to waive, the applicable height <br /> restriction to allow for the first floor plate height above adjacent sidewalk grade along the <br /> project frontage to be greater than 5 feet, as set forth in OWNER's AHP. <br /> (c)' Buildina Encroachment Into Front 15' Setback: OWNER has <br /> requested a reduction of, and City has agreed to reduce, the applicable minimum Building <br /> setback from 15' to 10' for a portion of the project frontage along Main Street, as set forth <br /> in the OWNER's AHP. <br /> (d) Above-Grade Garaqe Encroachment Into the 39' Rear Setback: <br /> OWNER has requested a reduction of, and City has agreed to reduce, the applicable rear <br /> setback requirement to allow for a minor encroachment by the above-grade garage into <br /> the minimum 39' rear setback from top-of-bank, as set forth in the OWNER's AHP. <br /> I <br /> (e) Reduction in Garaae Drive Aisle Width to 24': OWNER has I <br /> requested a reduction of, and City has agreed to reduce, the applicable requirement for I <br /> for drive aisle widths within the concrete parking garage, as set forth in the OWNER's <br /> AHP.
