Roberts, Esq. <br /> 801 Welch Road, Suite 205 <br /> Palo Alto, CA 94304 <br /> RE: APPEAL FROM THE DECISION OF THE ZONING ADMINISTRATOR OF <br /> THE CITY OF REDWOOD CITY IN GRANTING A USE PERMIT TO <br /> CONDUCT A CABARET AT 768 WOOpSIDE ROAD, REDWOOD CITY, <br /> CALIFORNIA (TENANT, SHOOTER MC GEE'S) - <br /> FINDINGS <br /> Public hearing having been duly noticed and held by this <br /> Council on October 14, 1985 on the abovementioned appeal, and <br /> appearance having been made by Bruce B. Robeits, attorney for the <br /> owner, Aldo Fontana ("Appellant") of the premises located at 768 <br /> - - Woodside Road, Redwood City, California (the "Subject Property"), <br /> testimony and documentary evidence having been presented to and <br /> considered by this Council, and the matter having been submitted, <br /> this Council hereby finds, determines and declares as follows: <br /> 1. By Notice of Official Action dated August 28, 1985 from <br /> the Zoninq Administrator Appellant was qranted a conditional use <br /> permit designated by File No. U 10131-5 (the "Use Permit") to <br /> operate a"cabaret" at the Subject Property, which operation is <br /> conducted by Appellant's tenant, under the name of "Shooter <br /> McGee's" <br /> 2. Condition No. 9 of the Use Permit provides in.pertinent <br /> part, as follows: <br /> "This Use Permit shall be valid for a period of <br /> ninety (90) days, at the end of which period an <br /> administrative hearing shall be held by the Zoning <br /> Administrator,... for a determination of whether <br /> or not the cabaret use may be allowed to <br /> continue." <br /> 3. Appellant had requested that hearing on this appeal be <br /> deferred, "...until the earlier of: (a) the last day to appeal <br /> the decision of the Zoning Administrator in connection with the <br />
