B. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> January 9, 2012 <br /> SUBJECT <br /> • An Ordinance Adding a new Article III to Chapter 1 of the Redwood City Code Relating <br /> to Appeals <br /> • An Ordinance Amending Miscellaneous Provisions of the Redwood City Code Relating <br /> to Appeals <br /> RECOMMENDATION <br /> Hold Public Hearing on Portion of Ordinance adopting San Mateo Environmental Health <br /> Code by reference <br /> Waive Second Reading and adopt an Ordinance Adding a New Article III to Chapter 1 <br /> relating to appeals <br /> Waive Second Reading and adopt an Ordinance Amending Miscellaneous Provisions of <br /> the Redwood City Code Relating to Appeals <br /> BACKGROUND <br /> At the December 12, 2011 City Council meeting, these two ordinances were introduced <br /> for first reading. The appeal and notice provisions in the Municipal Code and in the <br /> Zoning Ordinance are in need of updating to achieve consistency with state law and <br /> with other appeal provisions in the code. These two Ordinances are the first steps in <br /> that process. <br /> The first Ordinance adds a new Article III to Chapter 1 of the Code establishing uniform <br /> appeal procedures for the City. <br /> The second proposed ordinance is a housekeeping ordinance that amends various <br /> sections of the City Code to create consistency with new Article III of Chapter 1 relating <br /> to appeals. The significant changes are designating the City Manager instead of the City <br /> Council to hear many of the administrative appeals from a staff decision (like the Police <br /> Chief's denial of a public dance permit), making the deadline for filing an appeal <br /> consistent, and other minor changes necessary for uniformity. <br /> Because the second ordinance amends the appeal provisions of the City's <br /> environmental health code by adopting by reference San Mateo County's Environmental <br /> health Code, it is necessary to hold a public hearing and receive any comments from <br /> the public regarding the proposed ordinances. Notice of the hearing was published in <br /> the newspaper in accordance with state law. <br />
