40.11. -APPEALS: <br /> Any interested party may appeal any decision of the Commission pursuant to Section <br /> 40.10 to the City Council by filing an appeal within fifteen (15) days after the date of the <br /> notice of the Commission's decision. Such appeal shall be accompanied by a fee in an <br /> amount established by Council resolution and shall be filed, processed and heard in <br /> accordance with Chapter 1 of this Municipal Code. <br /> Section 36. Section 41.16 of the Redwood City Municipal Code regarding appeal of <br /> determinations of the City Engineer on Flood Plane issues is hereby amended to read as <br /> follows: <br /> 41.16. - APPEALS: <br /> The City Council of the City of Redwood City shall hear and decide appeals when it is <br /> aileged there is an error in any requirement, decision, or determination by the Floodplain <br /> Administrator in the enforcement or administration of this Chapter. <br /> Section 37. Section 42.6 of the Redwood City Municipal Code regarding appeal of relocation <br /> assistance determinations of the Community Development Director is hereby amended to read <br /> as follows: <br /> 42.6. - APPEALS: <br /> Any owner, developer, tenant or former tenant of affected property, or other interested <br /> person may appeal to the City Council a determination by the Director of the applicability <br /> of the provisions of this Chapter to any development or code enforcement proceeding, <br /> as the case may be, the authorization to pay, or the denial of payment of, relocation <br /> assistance, or the amount of any such assistance. Appeals shall be filed within fifteen <br /> (15) days of the date of the notice of determinations and shall be filed, processed and <br /> heard in accordance with the provisions of Chapter 1 of this Municipal Code. <br /> Section 38. Section 43.15 of the Redwood City Municipal Code regarding appeal of news rack <br /> permits determinations of the Community Development Director is hereby amended to read as <br /> follows: <br /> 43.15. - APPEALS: <br /> Any interested person may appeal any decision or determination of the Building <br /> Inspector to the Director by filing written notice of such appeal with the City Clerk within <br /> fifteen (15) days of the date of the notice of determination by the Building Inspector. Any <br /> decision made by the Director may be appealed to the City Manager by filing written <br /> notice of such appeal with the City Clerk within fifteen (15) days of such decision or <br /> determination. Such appeals shall be filed, processed and heard in accordance with the <br /> provisions of Chapter 1 of this Municipal Code. The City Manager's decision shall be <br /> final. <br /> Section 39. This ordinance is not a project subject to the California Environmental Quality <br /> Act. <br /> Section 40. The City Clerk shall publish this Ordinance in accordance with applicable law. <br /> Section 41.
