Council for their consideration in acting on the adoption of the Plan Amendment; <br />and <br />Whereas, the Planning commission has considered the proposed Fifth <br />Amendment, the Report to the city council on the Fifth Amendment, the General <br />Plan of the city (the "General Plan "), and other pertinent reports and documents; <br />and <br />Whereas, Part V of the Redevelopment Plan incorporates the General <br />Plan land uses and the- Fifth Amendment does not change this .Part of the Plan; <br />and <br />Whereas, the staff report accompanying this resolution .discusses the <br />Fifth Amendment's conformity to the General Plan. <br />NOW THEREFORE, BE lT RESOLVED that the Planning comrnissivn of the <br />City of Redwood City does hereby declare, determine and order as follows: <br />Section 1. Findings. The Planning commission hereby finds and <br />determines that: <br />(a) All required public notices have been given in connection <br />with the actions set forth in this Resolution <br />(h) Pursuant to section 33346 of the community <br />Redevelopment Lair, the proposed Fifth .Amendment conforms to the General <br />Plan <br />(c) Pursuant to section 65402 of the Government :code, with <br />respect to public activities which may be undertaken pursuant to the Fifth <br />Amendment, and that are referred to in section 6540P., such activities and <br />undertakings conform to the General Phan. <br />Section 2. Fie ort and Recommendations: The Planning <br />Commission hereby reports to the Agency and the city council the findings <br />referred to in section 1 .above, and recommends the approval .and .adoption of <br />the Fifth Amendment based on the following change: if the Agency utilizes <br />eminent domain proceedings to acquire property within the Project it must <br />commence such proceedings within 0 years of the effective date of the Fifth <br />Amendment to this Plan unless extended by subsequent amendment of the <br />Redevelopment Plan. <br />In the event that prior to its adoption of the Fifth Amendment, the city <br />Council desires to make any minor, technical, or clarifying changes to the Fifth <br />Amendment, the Planning Commission hereby finds and determines that any <br />such m nor, technical, or clarifying changes need not be referred to it for further <br />y g g <br />Pc reso - report - and recommendation <br />
