b. The IS was prepared in accordance with all legal requirements. <br />c. The Planning Commission has reviewed and analyzed the IS and other <br />information in the entire record and has considered the information <br />contained therein including the written and oral comments received at the <br />public hearing on the IS and the Project, prior to acting upon or approving <br />the Project; and the IS represents the independent judgment of the City of <br />Redwood City. <br />d. Based on substantial evidence in the record, as listed above, the <br />proposed Project is within the scope of the previously approved Downtown <br />Precise Plan and is adequately described in the previously certified <br />Downtown n Precise Plan Program EIR for purposes of CE A. The <br />Statement of overriding Considerations associated with adoption of the <br />program EIF addresses the environmental effects of the Project. <br />2. The Planning Commission finds that, as set forth in CE QA Guidelines section <br />15168, the proposed Project will not result in any new environmental effects <br />or require new mitigation measures beyond those identified in the Downtown <br />Precise Plan Program EIF and adopted upon approval of the Downtown <br />Precise Plan. No new environmental document is required. <br />3. The Notice of Determination that the Project is within the scope of the <br />Program EIR and that no further CEA document is necessary is hereby <br />approved and staff is directed to file such notice with the San Mateo county <br />Cleric's office. <br />4. Pursuant to Guidelines section 15091(e), the documents and other materials <br />that constitute the record of proceedings upon which the Planning <br />Commission has based its decision are looted in and may be obtained from, <br />the Office of the City Clerk at 1017 Middlefield Road, Redwood City, <br />California. The City Clerk is the custodian of records for all matters before the <br />city. <br />5. This Planning Commission does hereby make a the foregoing findings with <br />respect to the significant effects on the environment of such Project, as <br />identified in the IS, with the stipulations that all information in these findings is <br />intended as a summary of the full administrative record supporting the IS, <br />which full administrative record should be consulted for the full details <br />supporting these findings. <br />6. Severabilit E. If any terra, provision, or portion of these Findings or the <br />application of these Findings to a particular situation is held by a court to be <br />invalid, void or unenforceable, the remaining provisions of these Findings, or <br />ATTY /RES .21 9/ 291 MARSHALL I <br />EV:1212 111 <br />Page 2 of 4 <br />
