6.4. B. - Page 2 <br />administrative cost allowance, rents, interests and other revenues, and property taxes to <br />be allocated to the Successor Agency for the January 1, 2012 through June 30, 2012 <br />period. <br />The ROPS is not effective until it has been certified by an independent external auditor <br />and approved by the Oversight Board. The auditors are expected to review and certify <br />the ROPS and its relevant documents in March 2012. <br />By April 15, 2012, the certified ROPS is to be approved by the Oversight Board and <br />such approved and certified ROPS must be posted on the Successor Agency's website <br />and submitted to the State Department of Finance, the State Controller, and County <br />Auditor - Controller. By May 1, 2012, the ROPS replaces the Enforceable Obligation <br />Payment Schedule ( "EOPS ") under which the Successor Agency has been operating. <br />Only those payments listed in the approved ROPS can be made by the Successor <br />Agency. The Successor Agency prepares a new ROPS for each six month fiscal year <br />period thereafter for approval by the Oversight Board. <br />Enforceable Obligation Payment Schedule <br />In compliance with AB 1X 26, the RDA adopted an EOPS by resolution to allow itself to <br />make payments on debts and obligations listed on the EOPS. After the adoption of the <br />EOPS, staff was made aware that additional obligations needed to be listed on the <br />EOPS in order to receive funding to make the payments. As such, staff seeks an <br />amendment to the EOPS adopted on January 23, 2012. <br />ALTERNATIVES <br />The Successor Agency may revise the items listed in the draft ROPS. <br />The Successor Agency may approve, not approve, or approve a revised version of the <br />proposed amended EOPS. <br />FISCAL IMPACT <br />There is no fiscal impact for the preparation of the ROPS or amending the EOPS. <br />Health and Safety Code Section 34169, added as part of AB 1X 26, allows that the <br />EOPS may be amended at any public meeting of the RDA or its Successor Agency. <br />ENVIRONMENTAL REVIEW <br />The actions proposed by the Successor Agency are exempt from the California <br />Environmental Quality Act pursuant to CEQA Guidelines section 15378(b)(4), as they <br />are not considered a project subject to CEQA review because they do not involve a new <br />commitment to any specific project which may result in a potentially significant <br />environmental impact. <br />✓) I LL ` <br />aJEANNIE YOUNG <br />STAFF ORIGINATOR <br />
